| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter G, Chapter 152, Tax Code, is amended | |
| 12 | 12 | by adding Section 152.1223 to read as follows: | |
| 13 | 13 | Sec. 152.1223. ALLOCATION OF CERTAIN TAX REVENUE TO STATE | |
| 14 | 14 | HIGHWAY FUND. (a) Notwithstanding Section 152.122, in each state | |
| 15 | 15 | fiscal year beginning on or after September 1, 2018, the | |
| 16 | 16 | comptroller shall deposit to the credit of the state highway fund an | |
| 17 | 17 | amount of money that is equal to 50 percent of the money that is | |
| 18 | 18 | received under Sections 152.043, 152.045, 152.047, and 152.121 and | |
| 19 | 19 | is remaining after the comptroller makes the allocation required by | |
| 20 | 20 | Section 152.1222. | |
| 21 | 21 | (b) Money deposited to the credit of the state highway fund | |
| 22 | 22 | under this section: | |
| 23 | 23 | (1) may be appropriated only for a purpose authorized | |
| 24 | 24 | by Section 7-a, Article VIII, Texas Constitution; and | |
| 25 | 25 | (2) may not be used for toll roads. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2015. |
