21	5		relating to the scope of duties of an emergency medical
22	6		technician-paramedic and a licensed paramedic.
23	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
24	8		SECTION 1. Subchapter C, Chapter 773, Health and Safety
25	9		Code, is amended by adding Section 773.0496 to read as follows:
26	10		Sec. 773.0496. SCOPE OF EMERGENCY MEDICAL
27	11		TECHNICIAN-PARAMEDIC AND LICENSED PARAMEDIC DUTIES. (a) In this
28	12		section:
29	13		(1) "Advanced life support" means health care provided
30	14		to sustain life in an emergency, life-threatening situation. The
31	15		term includes the initiation of intravenous therapy, endotracheal
32	16		or esophageal intubation, electrical cardiac defibrillation or
33	17		cardioversion, and drug therapy procedures.
34	18		(2) "Direct supervision" means supervision of an
35	19		emergency medical technician-paramedic or licensed paramedic by a
36	20		licensed physician who is present in the same area or an area
37	21		adjacent to the area where an emergency medical
38	22		technician-paramedic or licensed paramedic performs a procedure
39	23		and who is immediately available to provide assistance and
40	24		direction during the performance of the procedure.
41	25		(b) Notwithstanding other law, a person who is certified
42	26		under this chapter as an emergency medical technician-paramedic or
43	27		a licensed paramedic, is acting under the delegation and direct
44	28		supervision of a licensed physician, and is authorized to provide
45	29		advanced life support by a health care facility may in accordance
46	30		with department rules provide advanced life support in the
47	31		facility's emergency or urgent care clinical setting, including a
48	32		hospital emergency room and a freestanding emergency medical care
49	33		facility.
50	34		SECTION 2. As soon as practicable after the effective date
51	35		of this Act, the executive commissioner of the Health and Human
52	36		Services Commission shall adopt any rules necessary to implement
53	37		Section 773.0496, Health and Safety Code, as added by this Act.
54	38		SECTION 3. This Act takes effect immediately if it receives
55	39		a vote of two-thirds of all the members elected to each house, as
56	40		provided by Section 39, Article III, Texas Constitution. If this
57	41		Act does not receive the vote necessary for immediate effect, this
58	42		Act takes effect September 1, 2015.
