7	5		relating to the maximum capacity of a container of wine sold to a

9	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	8		SECTION 1. Section 101.45, Alcoholic Beverage Code, is
11	9		amended to read as follows:
12	10		Sec. 101.45. CONTAINERS OF WINE: MAXIMUM CAPACITY. A
13	11		person may not sell wine to a retail dealer in a container with a
14	12		capacity greater than 15.5 [eight] gallons.
15	13		SECTION 2. (a) The change in law made by this Act applies
16	14		only to an offense committed on or after the effective date of this
17	15		Act. For purposes of this section, an offense is committed before
18	16		the effective date of this Act if any element of the offense occurs
19	17		before that date.
20	18		(b) An offense committed before the effective date of this
21	19		Act is covered by the law in effect when the offense was committed,
22	20		and the former law is continued in effect for that purpose.
23	21		SECTION 3. This Act takes effect immediately if it receives
24	22		a vote of two-thirds of all the members elected to each house, as
25	23		provided by Section 39, Article III, Texas Constitution. If this
26	24		Act does not receive the vote necessary for immediate effect, this
27	25		Act takes effect September 1, 2015.
