55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the ability of certain students to enroll full-time in
88 courses provided through the state virtual school network.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 30A.002(b), Education Code, is amended
1111 to read as follows:
1212 (b) A student is eligible to enroll full-time in courses
1313 provided through the state virtual school network only if the
1414 student:
1515 (1) was enrolled in a public school in this state in
1616 the preceding school year; or
1717 (2) [has been placed in substitute care in this
1818 state,] regardless of whether the student was enrolled in a public
1919 school in this state in the preceding school year:
2020 (A) has been placed in substitute care in this
2121 state;
2222 (B) is a dependent of a member of the United
2323 States military; or
2424 (C) has been prescribed to attend school through
2525 an alternative, distance learning setting by a licensed
2626 professional because of the student's medical, psychological, or
2727 educational condition.
2828 SECTION 2. Section 30A.107(c), Education Code, is amended
2929 to read as follows:
3030 (c) A student who resides in this state but who is not
3131 enrolled in a school district or open-enrollment charter school in
3232 this state as a full-time student may, subject to Section 30A.155,
3333 enroll in electronic courses through the state virtual school
3434 network. A student to whom this subsection applies:
3535 (1) [may not in any semester enroll in more than two
3636 electronic courses offered through the state virtual school
3737 network;
3838 [(2)] is not considered to be a public school student;
3939 (2) [(3)] must obtain access to a course provided
4040 through the network through the school district or open-enrollment
4141 charter school attendance zone in which the student resides;
4242 (3) [(4)] is not entitled to enroll in a course
4343 offered by a school district or open-enrollment charter school
4444 other than an electronic course provided through the network; and
4545 (4) [(5)] is not entitled to any right, privilege,
4646 activities, or services available to a student enrolled in a public
4747 school, other than the right to receive the appropriate unit of
4848 credit for completing an electronic course.
4949 SECTION 3. This Act applies beginning with the 2015-2016
5050 school year.
5151 SECTION 4. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2015.
