| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 396.022(a), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) A junkyard or an automotive wrecking and salvage yard | |
| 13 | 13 | may not be located: | |
| 14 | 14 | (1) within 50 feet of the right-of-way of a public | |
| 15 | 15 | street or [,] state highway; [,] or | |
| 16 | 16 | (2) within 50 feet of the nearest property line of a | |
| 17 | 17 | residence. | |
| 18 | 18 | SECTION 2. Section 396.022(a), Transportation Code, as | |
| 19 | 19 | amended by this Act, applies only to a junkyard or an automotive | |
| 20 | 20 | wrecking and salvage yard that begins operating on or after the | |
| 21 | 21 | effective date of this Act. A junkyard or an automotive wrecking | |
| 22 | 22 | and salvage yard operating before the effective date of this Act is | |
| 23 | 23 | governed by the law applicable immediately before the effective | |
| 24 | 24 | date of this Act, and that law is continued in effect for that | |
| 25 | 25 | purpose. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2015. |
