97 AN ACT
108 relating to developing a program to provide telemedicine medical
119 services to certain children.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1412 is amended by adding Section 32.076 to read as follows:
1513 Sec. 32.076. TELEMEDICINE MEDICAL SERVICES FOR CHILDREN
1614 WITH CHRONIC OR COMPLEX MEDICAL NEEDS. (a) In this section,
1715 "telemedicine medical service" means a health care service that is
1816 provided by a physician for purposes of patient assessment,
1917 diagnosis, consultation, or treatment, or for the transfer of
2018 medical data, and that requires the use of advanced
2119 telecommunications technology, other than telephone or facsimile
2220 technology, including:
2321 (1) compressed digital interactive video, audio, or
2422 data transmission;
2523 (2) clinical data transmission using computer imaging
2624 by way of still-image capture and store and forward; and
2725 (3) other technology that facilitates access to health
2826 care services or medical specialty expertise.
2927 (b) The commission shall develop and implement a program to:
3028 (1) enable an eligible child described under
3129 Subsection (c) to receive medical assistance benefits for health
3230 care services provided in the child's residence through
3331 telemedicine medical services; and
3432 (2) provide reimbursement for telemedicine medical
3533 services under Subdivision (1).
3634 (c) A child is eligible for inclusion in the program under
3735 this section if the child:
3836 (1) is a recipient of medical assistance; and
3937 (2) has been diagnosed with:
4038 (A) an end-stage solid organ disease; or
4139 (B) a condition that, as determined by commission
4240 rule, requires:
4341 (i) mechanical ventilation;
4442 (ii) the child to be technology-dependent;
4543 or
4644 (iii) the child to be treated by three or
4745 more specialists.
4846 (d) Not later than January 1, 2019, and at other times after
4947 that date as determined appropriate by the executive commissioner,
5048 the commission shall report to the legislature on results and
5149 outcomes of the program. A report must include:
5250 (1) an evaluation of clinical outcomes of the program,
5351 including the program's success in reducing expected emergency
5452 department visits; and
5553 (2) the program's impact on medical costs.
5654 (e) The executive commissioner may adopt rules to implement
5755 this section.
5856 SECTION 2. If before implementing any provision of this Act
5957 a state agency determines that a waiver or authorization from a
6058 federal agency is necessary for implementation of that provision,
6159 the agency affected by the provision shall request the waiver or
6260 authorization and may delay implementing that provision until the
6361 waiver or authorization is granted.
6462 SECTION 3. This Act takes effect September 1, 2015.
