55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the development of healthy nutrition and physical
88 activity guidelines for licensed child-care providers, public
99 school teachers, and public school administrators.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 114, Health and Safety Code, is amended
1212 by adding Section 114.009 to read as follows:
1313 Sec. 114.009. NUTRITION AND PHYSICAL ACTIVITY GUIDELINES
1414 FOR CHILD-CARE PROVIDERS. (a) The council shall develop wellness
1515 guidelines to educate licensed child-care providers, public school
1616 teachers, and public school administrators about serving as role
1717 models for children by:
1818 (1) practicing healthy nutrition; and
1919 (2) engaging in physical activity.
2020 (b) The council shall develop incentives to encourage
2121 licensed child-care providers, public school teachers, and public
2222 school administrators to follow the guidelines.
2323 (c) The council shall communicate the guidelines and
2424 incentives to licensed child-care providers, public school
2525 teachers, and public school administrators in this state in a
2626 manner that the council determines is appropriate.
2727 SECTION 2. The interagency obesity council shall develop
2828 the guidelines and incentives required by Sections 114.009(a) and
2929 (b), Health and Safety Code, as added by this Act, not later than
3030 January 1, 2016. The council shall communicate the guidelines and
3131 incentives as required by Section 114.009(c), as added by this Act,
3232 not later than July 1, 2016.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2015.
