114 relating to the creation of the Fulshear Municipal Utility
125 Districts Nos. 4, 5, and 6; granting a limited power of eminent
136 domain; providing authority to issue bonds; providing authority to
147 impose assessments, fees, and taxes.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 ARTICLE 1. CREATION OF MUNICIPAL UTILITY DISTRICTS
1710 SECTION 1.01. Subtitle F, Title 6, Special District Local
1811 Laws Code, is amended by adding Chapter 8494 to read as follows:
1912 CHAPTER 8494. FULSHEAR MUNICIPAL UTILITY DISTRICT NO. 4
2013 SUBCHAPTER A. GENERAL PROVISIONS
2114 Sec. 8494.001. DEFINITIONS. In this chapter:
2215 (1) "Board" means the district's board of directors.
2316 (2) "Commission" means the Texas Commission on
2417 Environmental Quality.
2518 (3) "Director" means a board member.
2619 (4) "District" means the Fulshear Municipal Utility
2720 District No. 4.
2821 Sec. 8494.002. NATURE OF DISTRICT. The district is a
2922 municipal utility district created under Section 59, Article XVI,
3023 Texas Constitution.
3124 Sec. 8494.003. CONFIRMATION AND DIRECTORS' ELECTION
3225 REQUIRED. The temporary directors shall hold an election to
3326 confirm the creation of the district and to elect five permanent
3427 directors as provided by Section 49.102, Water Code.
3528 Sec. 8494.004. CONSENT OF MUNICIPALITY REQUIRED. The
3629 temporary directors may not hold an election under Section 8494.003
3730 until each municipality in whose corporate limits or
3831 extraterritorial jurisdiction the district is located has
3932 consented by ordinance or resolution to the creation of the
4033 district and to the inclusion of land in the district.
4134 Sec. 8494.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4235 The district is created to serve a public purpose and benefit.
4336 (b) The district is created to accomplish the purposes of:
4437 (1) a municipal utility district as provided by
4538 general law and Section 59, Article XVI, Texas Constitution; and
4639 (2) Section 52, Article III, Texas Constitution, that
4740 relate to the construction, acquisition, improvement, operation,
4841 or maintenance of macadamized, graveled, or paved roads, or
4942 improvements, including storm drainage, in aid of those roads.
5043 Sec. 8494.006. INITIAL DISTRICT TERRITORY. (a) The
5144 district is initially composed of the territory described by
5245 Section 2.01 of the Act enacting this chapter.
5346 (b) The boundaries and field notes contained in Section 2.01
5447 of the Act enacting this chapter form a closure. A mistake made in
5548 the field notes or in copying the field notes in the legislative
5649 process does not affect the district's:
5750 (1) organization, existence, or validity;
5851 (2) right to issue any type of bond for the purposes
5952 for which the district is created or to pay the principal of and
6053 interest on a bond;
6154 (3) right to impose a tax; or
6255 (4) legality or operation.
6356 SUBCHAPTER B. BOARD OF DIRECTORS
6457 Sec. 8494.051. GOVERNING BODY; TERMS. (a) The district is
6558 governed by a board of five elected directors.
6659 (b) Except as provided by Section 8494.052, directors serve
6760 staggered four-year terms.
6861 Sec. 8494.052. TEMPORARY DIRECTORS. (a) On or after
6962 September 1, 2015, the owner or owners of a majority of the assessed
7063 value of the real property in the district may submit a petition to
7164 the commission requesting that the commission appoint as temporary
7265 directors the five persons named in the petition. The commission
7366 shall appoint as temporary directors the five persons named in the
7467 petition.
7568 (b) Temporary directors serve until the earlier of the date
7669 permanent directors are elected under Section 8494.003 or September
7770 1, 2019.
7871 (c) If permanent directors have not been elected under
7972 Section 8494.003 and the terms of the temporary directors have
8073 expired, successor temporary directors shall be appointed or
8174 reappointed as provided by Subsection (d) to serve terms that
8275 expire on the earlier of:
8376 (1) the date permanent directors are elected under
8477 Section 8494.003; or
8578 (2) the fourth anniversary of the date of the
8679 appointment or reappointment.
8780 (d) If Subsection (c) applies, the owner or owners of a
8881 majority of the assessed value of the real property in the district
8982 may submit a petition to the commission requesting that the
9083 commission appoint as successor temporary directors the five
9184 persons named in the petition. The commission shall appoint as
9285 successor temporary directors the five persons named in the
9386 petition.
9487 SUBCHAPTER C. POWERS AND DUTIES
9588 Sec. 8494.101. GENERAL POWERS AND DUTIES. The district has
9689 the powers and duties necessary to accomplish the purposes for
9790 which the district is created.
9891 Sec. 8494.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9992 DUTIES. The district has the powers and duties provided by the
10093 general law of this state, including Chapters 49 and 54, Water Code,
10194 applicable to municipal utility districts created under Section 59,
10295 Article XVI, Texas Constitution.
10396 Sec. 8494.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10497 52, Article III, Texas Constitution, the district may design,
10598 acquire, construct, finance, issue bonds for, improve, operate,
10699 maintain, and convey to this state, a county, or a municipality for
107100 operation and maintenance macadamized, graveled, or paved roads, or
108101 improvements, including storm drainage, in aid of those roads.
109102 Sec. 8494.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
110103 project must meet all applicable construction standards, zoning and
111104 subdivision requirements, and regulations of each municipality in
112105 whose corporate limits or extraterritorial jurisdiction the road
113106 project is located.
114107 (b) If a road project is not located in the corporate limits
115108 or extraterritorial jurisdiction of a municipality, the road
116109 project must meet all applicable construction standards,
117110 subdivision requirements, and regulations of each county in which
118111 the road project is located.
119112 (c) If the state will maintain and operate the road, the
120113 Texas Transportation Commission must approve the plans and
121114 specifications of the road project.
122115 Sec. 8494.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
123116 OR RESOLUTION. (a) Except as provided by this section, the
124117 district shall comply with all applicable requirements of any
125118 ordinance or resolution that is adopted under Section 54.016 or
126119 54.0165, Water Code, and that consents to the creation of the
127120 district or to the inclusion of land in the district.
128121 (b) Section 54.016(f), Water Code, does not apply to the
129122 district.
130123 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
131124 Sec. 8494.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
132125 district may issue, without an election, bonds and other
133126 obligations secured by:
134127 (1) revenue other than ad valorem taxes; or
135128 (2) contract payments described by Section 8494.153.
136129 (b) The district must hold an election in the manner
137130 provided by Chapters 49 and 54, Water Code, to obtain voter approval
138131 before the district may impose an ad valorem tax or issue bonds
139132 payable from ad valorem taxes.
140133 (c) The district may not issue bonds payable from ad valorem
141134 taxes to finance a road project unless the issuance is approved by a
142135 vote of a two-thirds majority of the district voters voting at an
143136 election held for that purpose.
144137 Sec. 8494.152. OPERATION AND MAINTENANCE TAX. (a) If
145138 authorized at an election held under Section 8494.151, the district
146139 may impose an operation and maintenance tax on taxable property in
147140 the district in accordance with Section 49.107, Water Code.
148141 (b) The board shall determine the tax rate. The rate may not
149142 exceed the rate approved at the election.
150143 Sec. 8494.153. CONTRACT TAXES. (a) In accordance with
151144 Section 49.108, Water Code, the district may impose a tax other than
152145 an operation and maintenance tax and use the revenue derived from
153146 the tax to make payments under a contract after the provisions of
154147 the contract have been approved by a majority of the district voters
155148 voting at an election held for that purpose.
156149 (b) A contract approved by the district voters may contain a
157150 provision stating that the contract may be modified or amended by
158151 the board without further voter approval.
159152 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
160153 Sec. 8494.201. AUTHORITY TO ISSUE BONDS AND OTHER
161154 OBLIGATIONS. The district may issue bonds or other obligations
162155 payable wholly or partly from ad valorem taxes, impact fees,
163156 revenue, contract payments, grants, or other district money, or any
164157 combination of those sources, to pay for any authorized district
165158 purpose.
166159 Sec. 8494.202. TAXES FOR BONDS. At the time the district
167160 issues bonds payable wholly or partly from ad valorem taxes, the
168161 board shall provide for the annual imposition of a continuing
169162 direct ad valorem tax, without limit as to rate or amount, while all
170163 or part of the bonds are outstanding as required and in the manner
171164 provided by Sections 54.601 and 54.602, Water Code.
172165 Sec. 8494.203. BONDS FOR ROAD PROJECTS. At the time of
173166 issuance, the total principal amount of bonds or other obligations
174167 issued or incurred to finance road projects and payable from ad
175168 valorem taxes may not exceed one-fourth of the assessed value of the
176169 real property in the district.
177170 SECTION 1.02. Subtitle F, Title 6, Special District Local

224217 Notwithstanding any other law, if all of the territory of the
225218 district is annexed by a municipality into the corporate limits of
226219 that municipality before the date of the election under Section
227220 8495.003, the district may not be dissolved and shall continue
228221 until the district is dissolved under Section 43.074, Local
229222 Government Code.
230223 (b) Section 54.016(f), Water Code, does not apply to the
231224 district.

278271 Sec. 8495.104. AUTHORITY FOR ROAD PROJECTS. Under Section
279272 52, Article III, Texas Constitution, the district may design,
280273 acquire, construct, finance, issue bonds for, improve, operate,
281274 maintain, and convey to this state, a county, or a municipality for
282275 operation and maintenance macadamized, graveled, or paved roads, or
283276 improvements, including storm drainage, in aid of those roads
284277 inside or outside the district.

379372 described by Section 2.03 of the Act enacting this chapter.

454447 general law of this state, including Chapter 57, Water Code,
455448 applicable to levee improvement districts created under Section 59,
456449 Article XVI, Texas Constitution.
457450 Sec. 8496.104. AUTHORITY FOR ROAD PROJECTS. Under Section
458451 52, Article III, Texas Constitution, the district may design,
459452 acquire, construct, finance, issue bonds for, improve, operate,
460453 maintain, and convey to this state, a county, or a municipality for
461454 operation and maintenance macadamized, graveled, or paved roads, or
462455 improvements, including storm drainage, in aid of those roads
463456 inside or outside the district.
464457 Sec. 8496.105. ROAD STANDARDS AND REQUIREMENTS. (a) A road
465458 project must meet all applicable construction standards, zoning and
466459 subdivision requirements, and regulations of each municipality in
467460 whose corporate limits or extraterritorial jurisdiction the road
468461 project is located.
469462 (b) If a road project is not located in the corporate limits
470463 or extraterritorial jurisdiction of a municipality, the road
471464 project must meet all applicable construction standards,
472465 subdivision requirements, and regulations of each county in which
473466 the road project is located.
474467 (c) If the state will maintain and operate the road, the
475468 Texas Transportation Commission must approve the plans and
476469 specifications of the road project.
477470 Sec. 8496.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
478471 OR RESOLUTION. The district shall comply with all applicable
479472 requirements of any ordinance or resolution that is adopted under
480473 Section 54.016 or 54.0165, Water Code, and that consents to the
481474 creation of the district or to the inclusion of land in the
482475 district.
483476 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
484477 Sec. 8496.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
485478 district may issue, without an election, bonds and other
486479 obligations secured by:
487480 (1) revenue other than ad valorem taxes; or
488481 (2) contract payments described by Section 8496.153.
489482 (b) The district must hold an election in the manner
490483 provided by Chapters 49 and 54, Water Code, to obtain voter approval
491484 before the district may impose an ad valorem tax or issue bonds
492485 payable from ad valorem taxes.
493486 (c) The district may not issue bonds payable from ad valorem
494487 taxes to finance a road project unless the issuance is approved by a
495488 vote of a two-thirds majority of the district voters voting at an
496489 election held for that purpose.
497490 Sec. 8496.152. OPERATION AND MAINTENANCE TAX. (a) If
498491 authorized at an election held under Section 8496.151, the district
499492 may impose an operation and maintenance tax on taxable property in
500493 the district in accordance with Section 49.107, Water Code.
501494 (b) The board shall determine the tax rate. The rate may not
502495 exceed the rate approved at the election.
503496 Sec. 8496.153. CONTRACT TAXES. (a) In accordance with
504497 Section 49.108, Water Code, the district may impose a tax other than
505498 an operation and maintenance tax and use the revenue derived from
506499 the tax to make payments under a contract after the provisions of
507500 the contract have been approved by a majority of the district voters
508501 voting at an election held for that purpose.
509502 (b) A contract approved by the district voters may contain a
510503 provision stating that the contract may be modified or amended by
511504 the board without further voter approval.
512505 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
513506 Sec. 8496.201. AUTHORITY TO ISSUE BONDS AND OTHER
514507 OBLIGATIONS. The district may issue bonds or other obligations
515508 payable wholly or partly from ad valorem taxes, impact fees,
516509 revenue, contract payments, grants, or other district money, or any
517510 combination of those sources, to pay for any authorized district
518511 purpose.
519512 Sec. 8496.202. TAXES FOR BONDS. At the time the district
520513 issues bonds payable wholly or partly from ad valorem taxes, the
521514 board shall provide for the annual imposition of a continuing
522515 direct ad valorem tax, without limit as to rate or amount, while all
523516 or part of the bonds are outstanding as required and in the manner
524517 provided by Sections 54.601 and 54.602, Water Code.
525518 Sec. 8496.203. BONDS FOR ROAD PROJECTS. At the time of
526519 issuance, the total principal amount of bonds or other obligations
527520 issued or incurred to finance road projects and payable from ad
528521 valorem taxes may not exceed one-fourth of the assessed value of the
529522 real property in the district.

941934 copy of this Act have been furnished to all persons, agencies,

943936 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
944937 Government Code.
945938 (b) The governor, one of the required recipients, has
946939 submitted the notice and Act to the Texas Commission on
947940 Environmental Quality.
948941 (c) The Texas Commission on Environmental Quality has filed
949942 its recommendations relating to this Act with the governor, the
950943 lieutenant governor, and the speaker of the house of
951944 representatives within the required time.
952945 (d) All requirements of the constitution and laws of this
953946 state and the rules and procedures of the legislature with respect
954947 to the notice, introduction, and passage of this Act are fulfilled
955948 and accomplished.
956949 SECTION 3.02. (a) If this Act does not receive a two-thirds
957950 vote of all the members elected to each house, Subchapter C, Chapter
958951 8494, Special District Local Laws Code, as added by Section 1.01 of
959952 this Act, is amended by adding Section 8494.106 to read as follows:
960953 Sec. 8494.106. NO EMINENT DOMAIN POWER. The district may
961954 not exercise the power of eminent domain.
962955 (b) This section is not intended to be an expression of a
963956 legislative interpretation of the requirements of Section 17(c),
964957 Article I, Texas Constitution.
965958 SECTION 3.03. (a) If this Act does not receive a two-thirds
966959 vote of all the members elected to each house, Subchapter C, Chapter
967960 8495, Special District Local Laws Code, as added by Section 1.02 of
968961 this Act, is amended by adding Section 8495.107 to read as follows:
969962 Sec. 8495.107. NO EMINENT DOMAIN POWER. The district may
970963 not exercise the power of eminent domain.
971964 (b) This section is not intended to be an expression of a
972965 legislative interpretation of the requirements of Section 17(c),

983976 SECTION 3.05. This Act takes effect September 1, 2015.
