88 AN ACT
99 relating to the authority of certain municipalities to undertake a
1010 qualified hotel project.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2303.003(8), Government Code, is amended
1313 to read as follows:
1414 (8) "Qualified hotel project" means:
1515 (A) a hotel proposed to be constructed by a
1616 municipality or a nonprofit municipally sponsored local government
1717 corporation created under the Texas Transportation Corporation
1818 Act, Chapter 431, Transportation Code, that is within 1,000 feet of
1919 a convention center owned by a municipality having a population of
2020 1,500,000 or more, including shops, parking facilities, and any
2121 other facilities ancillary to the hotel; [and]
2222 (B) a hotel proposed to be constructed,
2323 remodeled, or rehabilitated by a municipality or a nonprofit
2424 municipally sponsored local government corporation created under
2525 the Texas Transportation Corporation Act, Chapter 431,
2626 Transportation Code, that is within 3,000 feet of the property line
2727 of a convention center owned by a municipality having a population
2828 of more than 500,000 and that borders the United Mexican States; and
2929 (C) a hotel, including a privately owned hotel
3030 adjoining a convention center owned by a political subdivision of
3131 this state, proposed to be constructed by or in conjunction with a
3232 municipality having a population of more than 130,000 that is
3333 located within 50 miles of this state's border with Oklahoma, or by
3434 a nonprofit municipally sponsored local government corporation
3535 created under the Texas Transportation Corporation Act, Chapter
3636 431, Transportation Code, by that municipality, including shops,
3737 parking facilities, and any other facilities ancillary to the
3838 hotel.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2015.
