66 AN ACT
77 relating to the requirements for an application to vote an early
88 voting ballot by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 63.0101, Election Code, is amended to
1111 read as follows:
1212 Sec. 63.0101. DOCUMENTATION OF PROOF OF IDENTIFICATION.
1313 (a) The following documentation is an acceptable form of photo
1414 identification under this chapter:
1515 (1) a driver's license, election identification
1616 certificate, or personal identification card issued to the person
1717 by the Department of Public Safety that has not expired or that
1818 expired no earlier than 60 days before the date of presentation;
1919 (2) a United States military identification card that
2020 contains the person's photograph that has not expired or that
2121 expired no earlier than 60 days before the date of presentation;
2222 (3) a United States citizenship certificate issued to
2323 the person that contains the person's photograph;
2424 (4) a United States passport issued to the person that
2525 has not expired or that expired no earlier than 60 days before the
2626 date of presentation; or
2727 (5) a license to carry a concealed handgun issued to
2828 the person by the Department of Public Safety that has not expired
2929 or that expired no earlier than 60 days before the date of
3030 presentation.
3131 (b) If a person is 65 years of age or older, an expired
3232 driver's license or personal identification card issued to the
3333 person by the Department of Public Safety is an acceptable form of
3434 identification for the purpose of applying for a ballot to be voted
3535 by mail under Chapter 84.
3636 SECTION 2. Section 84.002(a), Election Code, is amended to
3737 read as follows:
3838 (a) An early voting ballot application must include:
3939 (1) the applicant's name, [and] the address at which
4040 the applicant is registered to vote, and, if the applicant is
4141 applying for a ballot to be voted by mail for the first time, a copy
4242 of one form of identification described by Section 63.0101;
4343 (2) for an application for a ballot to be voted by mail
4444 on the ground of absence from the county of residence, the address
4545 outside the applicant's county of residence to which the ballot is
4646 to be mailed;
4747 (3) for an application for a ballot to be voted by mail
4848 on the ground of age or disability, the address of the hospital,
4949 nursing home or other long-term care facility, or retirement
5050 center, or of a person related to the applicant within the second
5151 degree by affinity or the third degree by consanguinity, as
5252 determined under Chapter 573, Government Code, if the applicant is
5353 living at that address and that address is different from the
5454 address at which the applicant is registered to vote;
5555 (4) for an application for a ballot to be voted by mail
5656 on the ground of confinement in jail, the address of the jail or of a
5757 person related to the applicant within the degree described by
5858 Subdivision (3);
5959 (5) for an application for a ballot to be voted by mail
6060 on any ground, an indication of each election for which the
6161 applicant is applying for a ballot; and
6262 (6) an indication of the ground of eligibility for
6363 early voting.
6464 SECTION 3. Section 84.011(a), Election Code, is amended to
6565 read as follows:
6666 (a) The officially prescribed application form for an early
6767 voting ballot must include:
6868 (1) immediately preceding the signature space the
6969 statement: "I certify that the information given in this
7070 application is true, and I understand that giving false information
7171 in this application is a crime.";
7272 (2) a statement informing the applicant of the
7373 offenses prescribed by Sections 84.003 and 84.004;
7474 (3) spaces for entering an applicant's voter
7575 registration number and county election precinct of registration,
7676 with a statement informing the applicant that failure to furnish
7777 that information does not invalidate the application; and
7878 (4) on an application for a ballot to be voted by mail:
7979 (A) a space for an applicant applying on the
8080 ground of absence from the county of residence to indicate the date
8181 on or after which the applicant can receive mail at the address
8282 outside the county;
8383 (B) a space for indicating the fact that an
8484 applicant whose application is signed by a witness cannot make the
8585 applicant's mark and a space for indicating the relationship or
8686 lack of relationship of the witness to the applicant;
8787 (C) a space for entering an applicant's telephone
8888 number, with a statement informing the applicant that failure to
8989 furnish that information does not invalidate the application;
9090 (D) a space or box for an applicant applying on
9191 the ground of age or disability to indicate that the address to
9292 which the ballot is to be mailed is the address of a facility or
9393 relative described by Section 84.002(a)(3), if applicable;
9494 (E) a space or box for an applicant applying on
9595 the ground of confinement in jail to indicate that the address to
9696 which the ballot is to be mailed is the address of a relative
9797 described by Section 84.002(a)(4), if applicable;
9898 (F) spaces for entering the signature, printed
9999 name, and residence address of any person assisting the applicant;
100100 (G) a statement informing the applicant of the
101101 condition prescribed by Section 81.005; [and]
102102 (H) a statement informing the applicant of the
103103 requirement prescribed by Section 86.003(c); and
104104 (I) a statement informing the applicant of the
105105 requirement that the applicant include a copy of one form of
106106 identification described by Section 63.0101 if the applicant is
107107 applying for a ballot to be voted by mail for the first time.
108108 SECTION 4. Section 86.001, Election Code, is amended by
109109 adding Subsection (h) to read as follows:
110110 (h) The secretary of state shall by rule provide a system
111111 for maintaining information regarding the provision of
112112 identification with each initial application for a ballot to be
113113 voted by mail.
114114 SECTION 5. The changes in law made by this Act apply only to
115115 an application to vote an early voting ballot by mail submitted on
116116 or after the effective date of this Act. An application to vote an
117117 early voting ballot by mail submitted before the effective date of
118118 this Act is governed by the law in effect when the application was
119119 submitted, and the former law is continued in effect for that
120120 purpose.
121121 SECTION 6. This Act takes effect September 1, 2015.
