| 7 | 7 | | relating to parental notice on enrollment in a public school of a |

| 8 | 8 | | student who is not immunized. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 38.001, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (g) and (h) to read as follows: |
|---|
| 12 | 12 | | (g) When a person who has not received the immunizations |
|---|
| 13 | 13 | | required by this section enrolls in a public elementary or |
|---|
| 14 | 14 | | secondary school, the school shall provide notice of the person's |
|---|
| 15 | 15 | | enrollment and lacking immunizations to the parent or guardian of |
|---|
| 16 | 16 | | each student enrolled in the school. The notice may not identify |
|---|
| 17 | 17 | | the person lacking immunizations. |
|---|
| 18 | 18 | | (h) A student's parent or guardian who receives notice under |
|---|
| 19 | 19 | | Subsection (g) may request transfer of the student to another |
|---|
| 20 | 20 | | public school as provided by Subchapter B, Chapter 25. |
|---|
| 21 | 21 | | SECTION 2. Sections 38.001(g) and (h), Health and Safety |
|---|
| 22 | 22 | | Code, as added by this Act, apply beginning with the 2015-2016 |
|---|
| 23 | 23 | | school year. |
|---|
| 24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2015. |
