55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the expenditure of proceeds or property received from
88 criminal asset forfeiture.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 59.06, Code of Criminal Procedure, is
1111 amended by amending Subsections (d-3) and (d-4) and adding
1212 Subsections (d-5) and (g-1) to read as follows:
1313 (d-3) Except as otherwise provided by this article, an
1414 expenditure of proceeds or property received under this chapter is
1515 considered to be for a law enforcement purpose if the expenditure is
1616 made for an activity of a law enforcement agency that relates to the
1717 criminal and civil enforcement of the laws of this state, including
1818 an expenditure made for:
1919 (1) equipment, including vehicles, computers,
2020 firearms, protective body armor, furniture, software, uniforms,
2121 and maintenance equipment;
2222 (2) supplies, including office supplies, mobile phone
2323 and data account fees for employees, and Internet services;
2424 (3) investigative and training-related travel
2525 expenses, including payment for hotel rooms, airfare, meals, rental
2626 of and fuel for a motor vehicle, and parking;
2727 (4) conferences and training expenses, including fees
2828 and materials;
2929 (5) investigative costs, including payments to
3030 informants and lab expenses;
3131 (6) crime prevention and treatment programs;
3232 (7) facility costs, including building purchase,
3333 lease payments, remodeling and renovating, maintenance, and
3434 utilities;
3535 (8) witness-related costs, including travel and
3636 security; [and]
3737 (9) audit costs and fees, including audit preparation
3838 and professional fees; and
3939 (10) public awareness and education programs and
4040 services.
4141 (d-4) Except as otherwise provided by this article, an
4242 expenditure of proceeds or property received under this chapter is
4343 considered to be for an official purpose of an attorney's office if
4444 the expenditure is made for an activity of an attorney or office of
4545 an attorney representing the state that relates to the
4646 preservation, enforcement, or administration of the laws of this
4747 state, including an expenditure made for:
4848 (1) equipment, including vehicles, computers, visual
4949 aid equipment for litigation, firearms, body armor, furniture,
5050 software, and uniforms;
5151 (2) supplies, including office supplies, legal
5252 library supplies and access fees, mobile phone and data account
5353 fees for employees, and Internet services;
5454 (3) prosecution and training-related travel expenses,
5555 including payment for hotel rooms, airfare, meals, rental of and
5656 fuel for a motor vehicle, and parking;
5757 (4) conferences and training expenses, including fees
5858 and materials;
5959 (5) investigative costs, including payments to
6060 informants and lab expenses;
6161 (6) crime prevention and treatment programs;
6262 (7) facility costs, including building purchase,
6363 lease payments, remodeling and renovating, maintenance, and
6464 utilities;
6565 (8) legal fees, including court costs, witness fees,
6666 and related costs, including travel and security, audit costs, and
6767 professional fees; [and]
6868 (9) state bar and legal association dues; and
6969 (10) public awareness and education programs and
7070 services.
7171 (d-5) A law enforcement agency or attorney representing the
7272 state may expend proceeds or property received under this chapter
7373 only as described by Subsections (d-2), (d-3), and (d-4). Unless
7474 otherwise authorized under this chapter, proceeds or property
7575 received under this chapter may not be used for the direct or
7676 indirect benefit of any person.
7777 (g-1) Not later than the 10th day after the last day of each
7878 quarter of the fiscal year, all law enforcement agencies and
7979 attorneys representing the state who receive proceeds or property
8080 under this chapter shall publish a report detailing all
8181 expenditures made during the preceding quarter from the proceeds or
8282 property. Each law enforcement agency and attorney representing the
8383 state shall make the report available to the public on the agency's
8484 or attorney's Internet website, as applicable.
8585 SECTION 2. The changes in law made by this Act to Articles
8686 59.06(d-3) and (d-4), Code of Criminal Procedure, apply only to the
8787 expenditure of proceeds or property by a law enforcement agency or
8888 attorney representing the state on or after the effective date of
8989 this Act. The expenditure of proceeds or property by a law
9090 enforcement agency or attorney representing the state before the
9191 effective date of this Act is governed by the law in effect on the
9292 date the expenditure was made, and the former law is continued in
9393 effect for that purpose.
9494 SECTION 3. This Act takes effect September 1, 2015.
