55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the administration by certain health care professionals
88 of treatments, therapy, or medication ordered by an optometrist or
99 therapeutic optometrist.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 301.002(2), Occupations Code, is amended
1212 to read as follows:
1313 (2) "Professional nursing" means the performance of an
1414 act that requires substantial specialized judgment and skill, the
1515 proper performance of which is based on knowledge and application
1616 of the principles of biological, physical, and social science as
1717 acquired by a completed course in an approved school of
1818 professional nursing. The term does not include acts of medical
1919 diagnosis or the prescription of therapeutic or corrective
2020 measures. Professional nursing involves:
2121 (A) the observation, assessment, intervention,
2222 evaluation, rehabilitation, care and counsel, or health teachings
2323 of a person who is ill, injured, infirm, or experiencing a change in
2424 normal health processes;
2525 (B) the maintenance of health or prevention of
2626 illness;
2727 (C) the administration of a medication or
2828 treatment as ordered by a physician, podiatrist, [or] dentist, or
2929 therapeutic optometrist;
3030 (D) the supervision or teaching of nursing;
3131 (E) the administration, supervision, and
3232 evaluation of nursing practices, policies, and procedures;
3333 (F) the requesting, receiving, signing for, and
3434 distribution of prescription drug samples to patients at practices
3535 at which an advanced practice registered nurse is authorized to
3636 sign prescription drug orders as provided by Subchapter B, Chapter
3737 157;
3838 (G) the performance of an act delegated by a
3939 physician under Section 157.0512, 157.054, 157.058, or 157.059; and
4040 (H) the development of the nursing care plan.
4141 SECTION 2. Section 453.001(9), Occupations Code, is amended
4242 to read as follows:
4343 (9) "Referring practitioner" means a qualified
4444 licensed health care professional who, within the scope of
4545 professional licensure, may refer a person for health care
4646 services. The term includes:
4747 (A) a physician licensed to practice medicine by
4848 a state board of medical examiners;
4949 (B) a dentist licensed by a state board of dental
5050 examiners;
5151 (C) a chiropractor licensed by a state board of
5252 chiropractic examiners; [and]
5353 (D) a podiatrist licensed by a state board of
5454 podiatric medical examiners; and
5555 (E) an optometrist or therapeutic optometrist
5656 licensed by a state board of optometry.
5757 SECTION 3. Section 454.213(b), Occupations Code, is amended
5858 to read as follows:
5959 (b) Implementation of direct occupational therapy to a
6060 person for a specific health care condition must be based on a
6161 referral from:
6262 (1) a physician licensed by a state board of medical
6363 examiners;
6464 (2) a dentist licensed by a state board of dental
6565 examiners;
6666 (3) a chiropractor licensed by a state board of
6767 chiropractic examiners;
6868 (4) a podiatrist licensed by a state board of
6969 podiatric medical examiners; [or]
7070 (5) an optometrist or therapeutic optometrist
7171 licensed by a state board of optometry; or
7272 (6) another qualified, licensed health care
7373 professional who is authorized to refer for health care services
7474 within the scope of the professional's license.
7575 SECTION 4. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2015.
