55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to health benefit plan coverage for certain equipment and
88 supplies associated with diabetes treatment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 1358.051(1) and (2), Insurance Code,
1111 are amended to read as follows:
1212 (1) "Diabetes equipment" means:
1313 (A) blood glucose monitors, including
1414 noninvasive glucose monitors and glucose monitors designed to be
1515 used by blind individuals;
1616 (B) insulin pumps and associated supplies and
1717 appurtenances, including an insulin pump that works in conjunction
1818 with another medical device to provide automated or predictive
1919 insulin infusion suspend or control functionality as part of a
2020 system classified as an artificial pancreas device system by the
2121 United States Food and Drug Administration;
2222 (C) insulin infusion devices; [and]
2323 (D) podiatric appliances for the prevention of
2424 complications associated with diabetes; and
2525 (E) continuous glucose monitoring devices that
2626 continuously record glucose levels of individual users whether a
2727 freestanding device or integrated into an insulin pump.
2828 (2) "Diabetes supplies" means:
2929 (A) test strips for blood glucose monitors;
3030 (B) visual reading and urine test strips;
3131 (C) lancets and lancet devices;
3232 (D) insulin and insulin analogs;
3333 (E) injection aids;
3434 (F) syringes;
3535 (G) prescriptive and nonprescriptive oral agents
3636 for controlling blood sugar levels; [and]
3737 (H) glucagon emergency kits; and
3838 (I) supplies related to insulin pumps and
3939 continuous glucose monitoring devices, including insulin infusion
4040 sets, insulin reservoirs, glucose sensors, and glucose data
4141 transmitters.
4242 SECTION 2. This Act applies only to a health benefit plan
4343 that is delivered, issued for delivery, or renewed on or after
4444 September 1, 2015. A health benefit plan delivered, issued for
4545 delivery, or renewed before September 1, 2015, is governed by the
4646 law as it existed immediately before the effective date of this Act,
4747 and that law is continued in effect for that purpose.
4848 SECTION 3. This Act takes effect September 1, 2015.
