7 | 7 | | relating to health benefit plan coverage for certain equipment and |
---|
8 | 8 | | supplies associated with diabetes treatment. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 1358.051(1) and (2), Insurance Code, |
---|
11 | 11 | | are amended to read as follows: |
---|
12 | 12 | | (1) "Diabetes equipment" means: |
---|
13 | 13 | | (A) blood glucose monitors, including |
---|
14 | 14 | | noninvasive glucose monitors and glucose monitors designed to be |
---|
15 | 15 | | used by blind individuals; |
---|
16 | 16 | | (B) insulin pumps and associated supplies and |
---|
17 | 17 | | appurtenances, including an insulin pump that works in conjunction |
---|
18 | 18 | | with another medical device to provide automated or predictive |
---|
19 | 19 | | insulin infusion suspend or control functionality as part of a |
---|
20 | 20 | | system classified as an artificial pancreas device system by the |
---|
21 | 21 | | United States Food and Drug Administration; |
---|
22 | 22 | | (C) insulin infusion devices; [and] |
---|
23 | 23 | | (D) podiatric appliances for the prevention of |
---|
24 | 24 | | complications associated with diabetes; and |
---|
25 | 25 | | (E) continuous glucose monitoring devices that |
---|
26 | 26 | | continuously record glucose levels of individual users whether a |
---|
27 | 27 | | freestanding device or integrated into an insulin pump. |
---|
28 | 28 | | (2) "Diabetes supplies" means: |
---|
29 | 29 | | (A) test strips for blood glucose monitors; |
---|
30 | 30 | | (B) visual reading and urine test strips; |
---|
31 | 31 | | (C) lancets and lancet devices; |
---|
32 | 32 | | (D) insulin and insulin analogs; |
---|
33 | 33 | | (E) injection aids; |
---|
34 | 34 | | (F) syringes; |
---|
35 | 35 | | (G) prescriptive and nonprescriptive oral agents |
---|
36 | 36 | | for controlling blood sugar levels; [and] |
---|
37 | 37 | | (H) glucagon emergency kits; and |
---|
38 | 38 | | (I) supplies related to insulin pumps and |
---|
39 | 39 | | continuous glucose monitoring devices, including insulin infusion |
---|
40 | 40 | | sets, insulin reservoirs, glucose sensors, and glucose data |
---|
41 | 41 | | transmitters. |
---|
42 | 42 | | SECTION 2. This Act applies only to a health benefit plan |
---|
43 | 43 | | that is delivered, issued for delivery, or renewed on or after |
---|
44 | 44 | | September 1, 2015. A health benefit plan delivered, issued for |
---|
45 | 45 | | delivery, or renewed before September 1, 2015, is governed by the |
---|
46 | 46 | | law as it existed immediately before the effective date of this Act, |
---|
47 | 47 | | and that law is continued in effect for that purpose. |
---|
48 | 48 | | SECTION 3. This Act takes effect September 1, 2015. |
