66 AN ACT
77 relating to coverage of telehealth services or telemedicine medical
88 services under health benefit plans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1455.001, Insurance Code, is amended by
1111 amending Subdivision (3) and adding Subdivision (4) to read as
1212 follows:
1313 (3) "Telehealth service" or [and] "telemedicine
1414 medical service" means a health care service or medical service,
1515 respectively, that is provided through the use of advanced
1616 telecommunications technology for the purpose of:
1717 (A) patient assessment, diagnosis, consultation,
1818 or treatment; or
1919 (B) the transfer of medical data [have the
2020 meanings assigned by Section 57.042, Utilities Code].
2121 (4) "Telemedicine provider" means:
2222 (A) a physician who provides telemedicine
2323 medical services; or
2424 (B) a physician assistant or advanced practice
2525 nurse who:
2626 (i) provides telemedicine medical
2727 services; and
2828 (ii) is supervised by and has delegated
2929 authority from a physician licensed in this state.
3030 SECTION 2. Section 1455.004, Insurance Code, is amended by
3131 adding Subsections (c), (d), (e), and (f) to read as follows:
3232 (c) A health benefit plan may not cover a telemedicine
3333 medical service unless the telemedicine provider:
3434 (1) is licensed in this state;
3535 (2) has established a physician-patient relationship
3636 with the recipient of the service;
3737 (3) is able to verify the identity of the patient;
3838 (4) has discussed the risks and benefits of
3939 telemedicine medical services with the patient;
4040 (5) advises the patient to see a physician or other
4141 health care professional in person within a reasonable time if the
4242 patient's symptoms do not improve;
4343 (6) provides only services that are medically
4444 indicated;
4545 (7) adopts protocols to prevent fraud and abuse;
4646 (8) does not violate state or federal laws relating to
4747 patient privacy;
4848 (9) maintains medical records for all telemedicine
4949 medical services;
5050 (10) does not treat chronic pain with a controlled
5151 substance listed on Schedule II, III, IV, or V under Chapter 481,
5252 Health and Safety Code, at a site other than a site normally used
5353 for the provision of medical care; and
5454 (11) practices according to the appropriate standard
5555 of care for the patient's condition.
5656 (d) For the purposes of Subsection (c), a telemedicine
5757 provider may establish a physician-patient relationship in an
5858 initial encounter using telemedicine medical services.
5959 (e) For the purposes of Subsection (c), a telemedicine
6060 provider must ensure that the informed consent of the patient, or
6161 another appropriate individual authorized to make health care
6262 treatment decisions for the patient, is obtained before
6363 telemedicine medical services are provided.
6464 (f) For the purposes of Subsection (c), a telemedicine
6565 provider shall ensure that the confidentiality of the patient's
6666 medical information is maintained as required by Chapter 159,
6767 Occupations Code, or other applicable law.
6868 SECTION 3. The change in law made by this Act applies only
6969 to a health benefit plan delivered, issued for delivery, or renewed
7070 on or after January 1, 2016. A health benefit plan delivered,
7171 issued for delivery, or renewed before January 1, 2016, is governed
7272 by the law in effect immediately before the effective date of this
7373 Act, and that law is continued in effect for that purpose.
7474 SECTION 4. This Act takes effect September 1, 2015.
