205 relating to a developmentally disabled offender program
216 established by the Texas Department of Criminal Justice.
227 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
238 SECTION 1. This Act may be cited as the Radford Crocker
249 Memorial Act.
2510 SECTION 2. Subchapter B, Chapter 501, Government Code, is
2611 amended by adding Section 501.068 to read as follows:
2712 Sec. 501.068. DEVELOPMENTALLY DISABLED OFFENDER PROGRAM.
2813 (a) In this section, "offender" has the meaning assigned by Section
2914 501.091.
3015 (b) The department shall establish and maintain a program for
3116 offenders:
3217 (1) who are suspected of or identified as having an
3318 intellectual disability or borderline intellectual functioning;
3419 and
3520 (2) whose adaptive functioning is significantly
3621 impaired.
3722 (c) The program must provide an offender described by
3823 Subsection (b) with:
3924 (1) a safe environment while confined; and
4025 (2) specialized programs, treatments, and activities
4126 designed by the department to assist the offender in effectively
4227 managing, treating, or accommodating the offender's intellectual
4328 disability or borderline intellectual functioning.
4429 (d) The department may accept gifts, awards, or grants for
4530 the purpose of providing the services described by Subsection (b).
4631 SECTION 3. This Act takes effect September 1, 2015.
