22 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

23 | 8 | | SECTION 1. This Act may be cited as the Radford Crocker |
---|
24 | 9 | | Memorial Act. |
---|
25 | 10 | | SECTION 2. Subchapter B, Chapter 501, Government Code, is |
---|
26 | 11 | | amended by adding Section 501.068 to read as follows: |
---|
27 | 12 | | Sec. 501.068. DEVELOPMENTALLY DISABLED OFFENDER PROGRAM. |
---|
28 | 13 | | (a) In this section, "offender" has the meaning assigned by Section |
---|
29 | 14 | | 501.091. |
---|
30 | 15 | | (b) The department shall establish and maintain a program for |
---|
31 | 16 | | offenders: |
---|
32 | 17 | | (1) who are suspected of or identified as having an |
---|
33 | 18 | | intellectual disability or borderline intellectual functioning; |
---|
34 | 19 | | and |
---|
35 | 20 | | (2) whose adaptive functioning is significantly |
---|
36 | 21 | | impaired. |
---|
37 | 22 | | (c) The program must provide an offender described by |
---|
38 | 23 | | Subsection (b) with: |
---|
39 | 24 | | (1) a safe environment while confined; and |
---|
40 | 25 | | (2) specialized programs, treatments, and activities |
---|
41 | 26 | | designed by the department to assist the offender in effectively |
---|
42 | 27 | | managing, treating, or accommodating the offender's intellectual |
---|
43 | 28 | | disability or borderline intellectual functioning. |
---|
44 | 29 | | (d) The department may accept gifts, awards, or grants for |
---|
45 | 30 | | the purpose of providing the services described by Subsection (b). |
---|
46 | 31 | | SECTION 3. This Act takes effect September 1, 2015. |
