11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 541.201(6), Transportation Code, is |
---|
13 | 13 | | amended to read as follows: |
---|
14 | 14 | | (6) "Implement of husbandry" means: |
---|
15 | 15 | | (A) a vehicle, other than a passenger car or |
---|
16 | 16 | | truck, that is designed and adapted for use as a farm implement, |
---|
17 | 17 | | machinery, or tool for tilling the soil; |
---|
18 | 18 | | (B) a towed vehicle that transports to the field |
---|
19 | 19 | | and spreads fertilizer or agricultural chemicals; or |
---|
20 | 20 | | (C) a motor vehicle designed and adapted to |
---|
21 | 21 | | deliver feed to livestock. |
---|
22 | 22 | | SECTION 2. Section 622.901, Transportation Code, is amended |
---|
23 | 23 | | to read as follows: |
---|
24 | 24 | | Sec. 622.901. WIDTH EXCEPTIONS. (a) In this section, "farm |
---|
25 | 25 | | tractor" and "implement of husbandry" have the meanings assigned by |
---|
26 | 26 | | Section 541.201. |
---|
27 | 27 | | (b) The width limitation provided by Section 621.201 does |
---|
28 | 28 | | not apply to: |
---|
29 | 29 | | (1) highway building or maintenance machinery that is |
---|
30 | 30 | | traveling: |
---|
31 | 31 | | (A) during daylight on a public highway other |
---|
32 | 32 | | than a highway that is part of the national system of interstate and |
---|
33 | 33 | | defense highways; or |
---|
34 | 34 | | (B) for not more than 50 miles on a highway that |
---|
35 | 35 | | is part of the national system of interstate and defense highways; |
---|
36 | 36 | | (2) a vehicle traveling during daylight on a public |
---|
37 | 37 | | highway other than a highway that is part of the national system of |
---|
38 | 38 | | interstate and defense highways or traveling for not more than 50 |
---|
39 | 39 | | miles on a highway that is part of the national system of interstate |
---|
40 | 40 | | and defense highways if the vehicle is: |
---|
41 | 41 | | (A) a farm tractor or implement of husbandry; or |
---|
42 | 42 | | (B) a vehicle on which a farm tractor or |
---|
43 | 43 | | implement of husbandry, other than a tractor or implement being |
---|
44 | 44 | | transported from one dealer to another, is being moved by the owner |
---|
45 | 45 | | of the tractor or implement or by an agent or employee of the owner: |
---|
46 | 46 | | (i) to deliver the tractor or implement to a |
---|
47 | 47 | | new owner; |
---|
48 | 48 | | (ii) to transport the tractor or implement |
---|
49 | 49 | | to or from a mechanic for maintenance or repair; or |
---|
50 | 50 | | (iii) in the course of an agricultural |
---|
51 | 51 | | operation; |
---|
52 | 52 | | (3) machinery that is used solely for drilling water |
---|
53 | 53 | | wells, including machinery that is a unit or a unit mounted on a |
---|
54 | 54 | | conventional vehicle or chassis, and that is traveling: |
---|
55 | 55 | | (A) during daylight on a public highway other |
---|
56 | 56 | | than a highway that is part of the national system of interstate and |
---|
57 | 57 | | defense highways; or |
---|
58 | 58 | | (B) for not more than 50 miles on a highway that |
---|
59 | 59 | | is part of the national system of interstate and defense highways; |
---|
60 | 60 | | (4) a vehicle owned or operated by a public, private, |
---|
61 | 61 | | or volunteer fire department; |
---|
62 | 62 | | (5) a vehicle registered under Section 502.431; or |
---|
63 | 63 | | (6) a recreational vehicle to which Section 622.903 |
---|
64 | 64 | | applies. |
---|
65 | 65 | | SECTION 3. This Act takes effect September 1, 2015. |
