99 relating to requirements for certain farm vehicles when operating
1010 on a highway.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 541.201(6), Transportation Code, is
1313 amended to read as follows:
1414 (6) "Implement of husbandry" means:
1515 (A) a vehicle, other than a passenger car or
1616 truck, that is designed and adapted for use as a farm implement,
1717 machinery, or tool for tilling the soil;
1818 (B) a towed vehicle that transports to the field
1919 and spreads fertilizer or agricultural chemicals; or
2020 (C) a motor vehicle designed and adapted to
2121 deliver feed to livestock.
2222 SECTION 2. Section 622.901, Transportation Code, is amended
2323 to read as follows:
2424 Sec. 622.901. WIDTH EXCEPTIONS. (a) In this section, "farm
2525 tractor" and "implement of husbandry" have the meanings assigned by
2626 Section 541.201.
2727 (b) The width limitation provided by Section 621.201 does
2828 not apply to:
2929 (1) highway building or maintenance machinery that is
3030 traveling:
3131 (A) during daylight on a public highway other
3232 than a highway that is part of the national system of interstate and
3333 defense highways; or
3434 (B) for not more than 50 miles on a highway that
3535 is part of the national system of interstate and defense highways;
3636 (2) a vehicle traveling during daylight on a public
3737 highway other than a highway that is part of the national system of
3838 interstate and defense highways or traveling for not more than 50
3939 miles on a highway that is part of the national system of interstate
4040 and defense highways if the vehicle is:
4141 (A) a farm tractor or implement of husbandry; or
4242 (B) a vehicle on which a farm tractor or
4343 implement of husbandry, other than a tractor or implement being
4444 transported from one dealer to another, is being moved by the owner
4545 of the tractor or implement or by an agent or employee of the owner:
4646 (i) to deliver the tractor or implement to a
4747 new owner;
4848 (ii) to transport the tractor or implement
4949 to or from a mechanic for maintenance or repair; or
5050 (iii) in the course of an agricultural
5151 operation;
5252 (3) machinery that is used solely for drilling water
5353 wells, including machinery that is a unit or a unit mounted on a
5454 conventional vehicle or chassis, and that is traveling:
5555 (A) during daylight on a public highway other
5656 than a highway that is part of the national system of interstate and
5757 defense highways; or
5858 (B) for not more than 50 miles on a highway that
5959 is part of the national system of interstate and defense highways;
6060 (4) a vehicle owned or operated by a public, private,
6161 or volunteer fire department;
6262 (5) a vehicle registered under Section 502.431; or
6363 (6) a recreational vehicle to which Section 622.903
6464 applies.
6565 SECTION 3. This Act takes effect September 1, 2015.
