55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of a person to serve as a campaign
88 treasurer of a general-purpose political committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 252.0011, Election Code, is amended by
1111 amending Subsections (a), (b), and (c) and adding Subsections
1212 (a-1) and (a-2) to read as follows:
1313 (a) In this section, "election cycle" means the period
1414 beginning on January 1 of an odd-numbered year and ending on
1515 December 31 of the following even-numbered year.
1616 (a-1) Except as provided by Subsection (b) or (c), a person
1717 is ineligible for appointment as a campaign treasurer if the person
1818 is the campaign treasurer of a political committee that does not
1919 file a report required by Chapter 254.
2020 (a-2) A person is ineligible for appointment as a campaign
2121 treasurer of a general-purpose committee if the commission imposed
2222 a civil penalty on the person during:
2323 (1) the election cycle preceding the election cycle in
2424 which the person seeks to become a campaign treasurer; or
2525 (2) any previous election cycle if any amount of that
2626 civil penalty remained unpaid during the election cycle preceding
2727 the election cycle in which the person seeks to become a campaign
2828 treasurer.
2929 (b) The period for which a person is ineligible under
3030 Subsection (a-1) [(a)] for appointment as a campaign treasurer ends
3131 on the date on which the political committee in connection with
3232 which the person's ineligibility arose has filed each report
3333 required by Chapter 254 that was not timely filed or, subject to
3434 Subsection (a-2), has paid all fines and penalties in connection
3535 with the failure to file the report.
3636 (c) Subsection (a-1) [(a)] does not apply to a person if, in
3737 any semiannual reporting period prescribed by Chapter 254:
3838 (1) the political committee in connection with which
3939 the person's ineligibility arose did not accept political
4040 contributions that in the aggregate exceed $5,000 or make political
4141 expenditures that in the aggregate exceed $5,000; and
4242 (2) the candidate who or political committee that
4343 subsequently appoints the person does not accept political
4444 contributions that in the aggregate exceed $5,000 or make political
4545 expenditures that in the aggregate exceed $5,000.
4646 SECTION 2. This Act takes effect September 1, 2015.
