7 | 7 | | relating to the eligibility of a person to serve as a campaign |

8 | 8 | | treasurer of a general-purpose political committee. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 252.0011, Election Code, is amended by |
---|
11 | 11 | | amending Subsections (a), (b), and (c) and adding Subsections |
---|
12 | 12 | | (a-1) and (a-2) to read as follows: |
---|
13 | 13 | | (a) In this section, "election cycle" means the period |
---|
14 | 14 | | beginning on January 1 of an odd-numbered year and ending on |
---|
15 | 15 | | December 31 of the following even-numbered year. |
---|
16 | 16 | | (a-1) Except as provided by Subsection (b) or (c), a person |
---|
17 | 17 | | is ineligible for appointment as a campaign treasurer if the person |
---|
18 | 18 | | is the campaign treasurer of a political committee that does not |
---|
19 | 19 | | file a report required by Chapter 254. |
---|
20 | 20 | | (a-2) A person is ineligible for appointment as a campaign |
---|
21 | 21 | | treasurer of a general-purpose committee if the commission imposed |
---|
22 | 22 | | a civil penalty on the person during: |
---|
23 | 23 | | (1) the election cycle preceding the election cycle in |
---|
24 | 24 | | which the person seeks to become a campaign treasurer; or |
---|
25 | 25 | | (2) any previous election cycle if any amount of that |
---|
26 | 26 | | civil penalty remained unpaid during the election cycle preceding |
---|
27 | 27 | | the election cycle in which the person seeks to become a campaign |
---|
28 | 28 | | treasurer. |
---|
29 | 29 | | (b) The period for which a person is ineligible under |
---|
30 | 30 | | Subsection (a-1) [(a)] for appointment as a campaign treasurer ends |
---|
31 | 31 | | on the date on which the political committee in connection with |
---|
32 | 32 | | which the person's ineligibility arose has filed each report |
---|
33 | 33 | | required by Chapter 254 that was not timely filed or, subject to |
---|
34 | 34 | | Subsection (a-2), has paid all fines and penalties in connection |
---|
35 | 35 | | with the failure to file the report. |
---|
36 | 36 | | (c) Subsection (a-1) [(a)] does not apply to a person if, in |
---|
37 | 37 | | any semiannual reporting period prescribed by Chapter 254: |
---|
38 | 38 | | (1) the political committee in connection with which |
---|
39 | 39 | | the person's ineligibility arose did not accept political |
---|
40 | 40 | | contributions that in the aggregate exceed $5,000 or make political |
---|
41 | 41 | | expenditures that in the aggregate exceed $5,000; and |
---|
42 | 42 | | (2) the candidate who or political committee that |
---|
43 | 43 | | subsequently appoints the person does not accept political |
---|
44 | 44 | | contributions that in the aggregate exceed $5,000 or make political |
---|
45 | 45 | | expenditures that in the aggregate exceed $5,000. |
---|
46 | 46 | | SECTION 2. This Act takes effect September 1, 2015. |
