99 relating to mental health first aid training for school district
1010 employees and school resource officers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1001.201, Health and Safety Code, as
1313 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
1414 Regular Session, 2013, is amended by adding Subdivisions (4) and
1515 (5) to read as follows:
1616 (4) "School district employee" means a person employed
1717 by a school district who regularly interacts with students through
1818 the course of the person's duties, including an educator, a
1919 secretary, a school bus driver, or a cafeteria worker.
2020 (5) "School resource officer" has the meaning assigned
2121 by Section 1701.601, Occupations Code.
2222 SECTION 2. Subchapter H, Chapter 1001, Health and Safety
2323 Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd
2424 Legislature, Regular Session, 2013, is amended by adding Section
2525 1001.2015 to read as follows:
2626 Sec. 1001.2015. LIMITATION ON GRANTS. For each state
2727 fiscal year, the department may give to a local mental health
2828 authority in the form of grants under Sections 1001.202 and
2929 1001.203 an amount that may not exceed the lesser of:
3030 (1) three percent of the total amount appropriated to
3131 the department for making grants under those sections; or
3232 (2) $70,000.
3333 SECTION 3. Section 1001.202(b), Health and Safety Code, as
3434 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
3535 Regular Session, 2013, is amended to read as follows:
3636 (b) The [Except as provided by Subsection (c), the]
3737 department shall make each grant to a local mental health authority
3838 under this section in an amount equal to $1,000 times the number of
3939 employees or contractors of the authority whose training as mental
4040 health first aid trainers will be paid by the grant.
4141 SECTION 4. Sections 1001.203(a) and (c), Health and Safety
4242 Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd
4343 Legislature, Regular Session, 2013, are amended to read as follows:
4444 (a) To the extent funds are appropriated to the department
4545 for that purpose, the department shall make grants to local mental
4646 health authorities to provide an approved mental health first aid
4747 training program, administered by mental health first aid trainers,
4848 at no cost to school district employees and school resource
4949 officers [educators].
5050 (c) The [Subject to the limit provided by Subsection (b),
5151 out of the funds appropriated to the department for making grants
5252 under this section, the] department shall grant $100 to a local
5353 mental health authority for each school district employee or school
5454 resource officer [educator] who successfully completes a mental
5555 health first aid training program provided by the authority under
5656 this section.
5757 SECTION 5. Subchapter H, Chapter 1001, Health and Safety
5858 Code, as added by Chapter 1306 (H.B. 3793), Acts of the 83rd
5959 Legislature, Regular Session, 2013, is amended by adding Section
6060 1001.2031 to read as follows:
6161 Sec. 1001.2031. SUPPLEMENTAL GRANTS FOR TRAINING CERTAIN
6262 EDUCATORS IN MENTAL HEALTH FIRST AID. For each state fiscal year,
6363 the department may allocate any unobligated money appropriated for
6464 making grants under Sections 1001.202 and 1001.203 for supplemental
6565 grants. The department may give a supplemental grant to a local
6666 mental health authority that submits to the department a revised
6767 plan as provided under Section 1001.204 that demonstrates how the
6868 additional grant money would be used if made available to the
6969 authority.
7070 SECTION 6. Section 1001.204(a), Health and Safety Code, as
7171 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
7272 Regular Session, 2013, is amended to read as follows:
7373 (a) Not later than July [October] 1 of each state fiscal
7474 year for which a local mental health authority will seek a grant
7575 from the department under Section 1001.203, the authority shall
7676 submit to the department a plan demonstrating the manner in which
7777 grants made to the authority under that section will be used:
7878 (1) to train individuals in mental health first aid
7979 throughout the authority's local service area to maximize the
8080 number of children who have direct contact with an individual who
8181 has successfully completed a mental health first aid training
8282 program provided by the authority;
8383 (2) to meet the greatest needs of the authority's local
8484 service area, as identified by the authority; and
8585 (3) to complement existing resources and not duplicate
8686 established mental health first aid training efforts.
8787 SECTION 7. Section 1001.205, Health and Safety Code, as
8888 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
8989 Regular Session, 2013, is amended to read as follows:
9090 Sec. 1001.205. REPORTS. (a) Not later than September 30
9191 [July 1] of each year, a local mental health authority shall provide
9292 to the department the number of:
9393 (1) employees and contractors of the authority who
9494 were trained as mental health first aid trainers under Section
9595 1001.202 during the preceding fiscal year;
9696 (2) educators, school district employees other than
9797 educators, and school resource officers who completed a mental
9898 health first aid training program offered by the authority under
9999 Section 1001.203 during the preceding fiscal [calendar] year; and
100100 (3) individuals who are not school district employees
101101 or school resource officers [educators] who completed a mental
102102 health first aid training program offered by the authority during
103103 the preceding fiscal [calendar] year.
104104 (b) Not later than December 1 [August 1] of each year, the
105105 department shall compile the information submitted by local mental
106106 health authorities as required by Subsection (a) and submit a
107107 report to the legislature containing the number of:
108108 (1) authority employees and contractors trained as
109109 mental health first aid trainers during the preceding fiscal year;
110110 (2) educators, school district employees other than
111111 educators, and school resource officers who completed a mental
112112 health first aid training program provided by an authority during
113113 the preceding fiscal [calendar] year; and
114114 (3) individuals who are not school district employees
115115 or school resource officers [educators] who completed a mental
116116 health first aid training program provided by an authority during
117117 the preceding fiscal [calendar] year.
118118 SECTION 8. The following are repealed:
119119 (1) Section 1001.202(c), Health and Safety Code, as
120120 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
121121 Regular Session, 2013; and
122122 (2) Section 1001.203(b), Health and Safety Code, as
123123 added by Chapter 1306 (H.B. 3793), Acts of the 83rd Legislature,
124124 Regular Session, 2013.
125125 SECTION 9. This Act takes effect immediately if it receives
126126 a vote of two-thirds of all the members elected to each house, as
127127 provided by Section 39, Article III, Texas Constitution. If this
128128 Act does not receive the vote necessary for immediate effect, this
129129 Act takes effect September 1, 2015.
