55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a determination of school district transportation costs
88 and a modification of the transportation allotment under the
99 foundation school program on the basis of those costs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 42.155, Education Code, is amended by
1212 amending Subsection (c) and adding Subsections (c-1) and (c-2) to
1313 read as follows:
1414 (c) Each district or county operating a regular
1515 transportation system is entitled to an allotment based on the
1616 daily cost per regular eligible student of operating and
1717 maintaining the regular transportation system and the linear
1818 density of that system. In determining the cost, the commissioner
1919 shall give consideration to factors affecting the actual cost of
2020 providing these transportation services in each district or county.
2121 The average actual cost is to be computed by the commissioner and
2222 included for consideration by the legislature in the General
2323 Appropriations Act. The allotment per mile of approved route may
2424 not be less than the amount described by Subsection (c-2) or exceed
2525 the amount set by appropriation.
2626 (c-1) For each linear density grouping established in Rider
2727 5, page III-6, Chapter 1411 (S.B. 1), Acts of the 83rd Legislature,
2828 Regular Session, 2013 (the General Appropriations Act), the agency
2929 shall determine the average school district cost per mile of
3030 providing regular transportation services during the 2012-2013,
3131 2013-2014, and 2014-2015 school years.
3232 (c-2) For purposes of Subsection (c), beginning with the
3333 state fiscal biennium beginning September 1, 2015, the allotment
3434 per mile of approved route for each linear density grouping may not
3535 be less than 50 percent of the average cost per mile for the
3636 grouping determined by the agency under Subsection (c-1).
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2015.
