104 AN ACT
115 relating to an established schedule of payments from the foundation
126 school fund of the yearly entitlement of certain open-enrollment
137 charter schools.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Subchapter E, Chapter 42, Education Code, is
1610 amended by adding Section 42.2591 to read as follows:
1711 Sec. 42.2591. FOUNDATION SCHOOL FUND TRANSFERS TO CERTAIN
1812 CHARTER SCHOOLS. (a) On the request of an open-enrollment charter
1913 school, the commissioner shall compare the student enrollment of
2014 the open-enrollment charter school for the current school year to
2115 the student enrollment of the school during the preceding school
2216 year. If the number of students enrolled at the open-enrollment
2317 charter school for the current school year has increased by 10
2418 percent or more from the number of students enrolled during the
2519 preceding school year, the open-enrollment charter school may
2620 request that payments from the foundation school fund to the school
2721 for the following school year and each subsequent school year,
2822 subject to Subsection (b), be made according to the schedule
2923 provided under Subsection (c).
3024 (b) An open-enrollment charter school that qualifies to
3125 receive funding as provided by this section is entitled to receive
3226 funding in that manner for three school years. On the expiration of
3327 that period, the commissioner shall determine the eligibility of
3428 the open-enrollment charter school to continue receiving payments
3529 from the foundation school fund under this section for an
3630 additional three school years. Subsequently, the open-enrollment
3731 charter school must reestablish eligibility in the manner provided
3832 by this subsection every three school years.
3933 (c) Payments from the foundation school fund to an
4034 open-enrollment charter school under this section shall be made as
4135 follows:
4236 (1) 22 percent of the yearly entitlement of the school
4337 shall be paid in an installment to be made on or before the 25th day
4438 of September of a fiscal year;
4539 (2) 18 percent of the yearly entitlement of the school
4640 shall be paid in an installment to be made on or before the 25th day
4741 of October;
4842 (3) 9.5 percent of the yearly entitlement of the
4943 school shall be paid in an installment to be made on or before the
5044 25th day of November;
5145 (4) four percent of the yearly entitlement of the
5246 school shall be paid in an installment to be made on or before the
5347 25th day of December;
5448 (5) four percent of the yearly entitlement of the
5549 school shall be paid in an installment to be made on or before the
5650 25th day of January;
5751 (6) four percent of the yearly entitlement of the
5852 school shall be paid in an installment to be made on or before the
5953 25th day of February;
6054 (7) four percent of the yearly entitlement of the
6155 school shall be paid in an installment to be made on or before the
6256 25th day of March;
6357 (8) 7.5 percent of the yearly entitlement of the
6458 school shall be paid in an installment to be made on or before the
6559 25th day of April;
6660 (9) five percent of the yearly entitlement of the
6761 school shall be paid in an installment to be made on or before the
6862 25th day of May;
6963 (10) seven percent of the yearly entitlement of the
7064 school shall be paid in an installment to be made on or before the
7165 25th day of June;
7266 (11) seven percent of the yearly entitlement of the
7367 school shall be paid in an installment to be made on or before the
7468 25th day of July; and
7569 (12) eight percent of the yearly entitlement of the
7670 school shall be paid in an installment to be made on or before the
7771 25th day of August.
7872 (d) The amount of any installment required by this section
7973 may be modified to provide an open-enrollment charter school with
8074 the proper amount to which the school may be entitled by law and to
8175 correct errors in the allocation or distribution of funds.
8276 (e) Previously unpaid additional funds from prior fiscal
8377 years owed to an open-enrollment charter school shall be paid to the
8478 school together with the September payment of the current fiscal
8579 year entitlement.
8680 SECTION 2. (a) Section 42.2591, Education Code, as added by
8781 this Act, applies only to a payment from the foundation school fund
8882 that is made on or after September 1, 2015. A payment to an
8983 open-enrollment charter school from the foundation school fund that
9084 is made before September 1, 2015, is governed by the law in effect
9185 on the date the payment was made, and the former law is continued in
9286 effect for that purpose.
9387 (b) The commissioner of education shall determine the
9488 eligibility of an open-enrollment charter school to receive
9589 payments under Section 42.2591, Education Code, as added by this
9690 Act, for the 2015-2016 school year based on the growth in the
9791 school's enrollment between the 2013-2014 and 2014-2015 school
9892 years.
9993 SECTION 3. This Act takes effect immediately if it receives
10094 a vote of two-thirds of all the members elected to each house, as
10195 provided by Section 39, Article III, Texas Constitution. If this
10296 Act does not receive the vote necessary for immediate effect, this
10397 Act takes effect September 1, 2015.
