| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 39.917 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.917. REPORT ON MINIMUM USAGE FEES AND USAGE |
|---|
| 13 | 13 | | CREDITS. (a) In this section: |
|---|
| 14 | 14 | | (1) "Minimum usage fee" means a fee charged to a |
|---|
| 15 | 15 | | residential retail electric customer that is imposed based on the |
|---|
| 16 | 16 | | amount of electricity the customer uses and is not imposed on one or |
|---|
| 17 | 17 | | more other customers who use more electricity. |
|---|
| 18 | 18 | | (2) "Usage credit" means a credit to a residential |
|---|
| 19 | 19 | | retail electric customer that is given based on the amount of |
|---|
| 20 | 20 | | electricity the customer uses and is not credited to one or more |
|---|
| 21 | 21 | | other customers who use less electricity. |
|---|
| 22 | 22 | | (b) The commission shall collect information relating to |
|---|
| 23 | 23 | | retail electric providers' use of minimum usage fees and usage |
|---|
| 24 | 24 | | credits, including: |
|---|
| 25 | 25 | | (1) the number of customers on whom a minimum usage fee |
|---|
| 26 | 26 | | is imposed; |
|---|
| 27 | 27 | | (2) the number of customers who are credited with a |
|---|
| 28 | 28 | | usage credit; |
|---|
| 29 | 29 | | (3) the number of retail electric providers who impose |
|---|
| 30 | 30 | | a minimum usage fee on certain customers; |
|---|
| 31 | 31 | | (4) the number of retail electric providers who credit |
|---|
| 32 | 32 | | certain customers with a usage credit; |
|---|
| 33 | 33 | | (5) the number of retail electric provider plans |
|---|
| 34 | 34 | | offered to the public that provide for the imposition of a minimum |
|---|
| 35 | 35 | | usage fee on certain customers; |
|---|
| 36 | 36 | | (6) the number of retail electric provider plans |
|---|
| 37 | 37 | | offered to the public that provide for the award of a usage credit |
|---|
| 38 | 38 | | to certain customers; |
|---|
| 39 | 39 | | (7) the kilowatt hour usage threshold at which the |
|---|
| 40 | 40 | | minimum usage fee is imposed and the amount of the fee or charge for |
|---|
| 41 | 41 | | each plan that provides for the imposition of a minimum usage fee; |
|---|
| 42 | 42 | | (8) the kilowatt hour usage threshold at which the |
|---|
| 43 | 43 | | usage credit is awarded and the amount of the credit for each plan |
|---|
| 44 | 44 | | that provides for the award of a usage credit; |
|---|
| 45 | 45 | | (9) the total revenue attributable to the imposition |
|---|
| 46 | 46 | | of the minimum usage fee for each retail electric provider that |
|---|
| 47 | 47 | | offers a plan that includes a minimum usage fee; |
|---|
| 48 | 48 | | (10) the total revenue attributable to the imposition |
|---|
| 49 | 49 | | of the minimum usage fee on low-income retail electric customers |
|---|
| 50 | 50 | | for each retail electric provider that offers a plan that includes a |
|---|
| 51 | 51 | | minimum usage fee; and |
|---|
| 52 | 52 | | (11) the total number of electric bills issued during |
|---|
| 53 | 53 | | the preceding year that included either a minimum usage fee or a |
|---|
| 54 | 54 | | usage credit. |
|---|
| 55 | 55 | | (c) Not later than January 31 of each year, the commission |
|---|
| 56 | 56 | | shall prepare and submit to the legislature a report that contains |
|---|
| 57 | 57 | | and summarizes the information collected during the preceding |
|---|
| 58 | 58 | | calendar year. |
|---|
| 59 | 59 | | SECTION 2. This Act takes effect September 1, 2015. |
