66 AN ACT
77 relating to a report by the Public Utility Commission of Texas on
88 retail electric service minimum usage fees and usage credits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.917 to read as follows:
1212 Sec. 39.917. REPORT ON MINIMUM USAGE FEES AND USAGE
1313 CREDITS. (a) In this section:
1414 (1) "Minimum usage fee" means a fee charged to a
1515 residential retail electric customer that is imposed based on the
1616 amount of electricity the customer uses and is not imposed on one or
1717 more other customers who use more electricity.
1818 (2) "Usage credit" means a credit to a residential
1919 retail electric customer that is given based on the amount of
2020 electricity the customer uses and is not credited to one or more
2121 other customers who use less electricity.
2222 (b) The commission shall collect information relating to
2323 retail electric providers' use of minimum usage fees and usage
2424 credits, including:
2525 (1) the number of customers on whom a minimum usage fee
2626 is imposed;
2727 (2) the number of customers who are credited with a
2828 usage credit;
2929 (3) the number of retail electric providers who impose
3030 a minimum usage fee on certain customers;
3131 (4) the number of retail electric providers who credit
3232 certain customers with a usage credit;
3333 (5) the number of retail electric provider plans
3434 offered to the public that provide for the imposition of a minimum
3535 usage fee on certain customers;
3636 (6) the number of retail electric provider plans
3737 offered to the public that provide for the award of a usage credit
3838 to certain customers;
3939 (7) the kilowatt hour usage threshold at which the
4040 minimum usage fee is imposed and the amount of the fee or charge for
4141 each plan that provides for the imposition of a minimum usage fee;
4242 (8) the kilowatt hour usage threshold at which the
4343 usage credit is awarded and the amount of the credit for each plan
4444 that provides for the award of a usage credit;
4545 (9) the total revenue attributable to the imposition
4646 of the minimum usage fee for each retail electric provider that
4747 offers a plan that includes a minimum usage fee;
4848 (10) the total revenue attributable to the imposition
4949 of the minimum usage fee on low-income retail electric customers
5050 for each retail electric provider that offers a plan that includes a
5151 minimum usage fee; and
5252 (11) the total number of electric bills issued during
5353 the preceding year that included either a minimum usage fee or a
5454 usage credit.
5555 (c) Not later than January 31 of each year, the commission
5656 shall prepare and submit to the legislature a report that contains
5757 and summarizes the information collected during the preceding
5858 calendar year.
5959 SECTION 2. This Act takes effect September 1, 2015.
