| 7 | 7 | | relating to the membership of the State Board of Dental Examiners. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 9 | 9 | | SECTION 1. Section 252.001(a), Occupations Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (a) The State Board of Dental Examiners consists of 15 |
|---|
| 12 | 12 | | members appointed by the governor with the advice and consent of the |
|---|
| 13 | 13 | | senate as follows: |
|---|
| 14 | 14 | | (1) seven [eight] reputable dentist members who reside |
|---|
| 15 | 15 | | in this state and have been actively engaged in the practice of |
|---|
| 16 | 16 | | dentistry for at least the five years preceding appointment; |
|---|
| 17 | 17 | | (2) two reputable dental hygienist members who reside |
|---|
| 18 | 18 | | in this state and have been actively engaged in the practice of |
|---|
| 19 | 19 | | dental hygiene for at least the five years preceding appointment; |
|---|
| 20 | 20 | | [and] |
|---|
| 21 | 21 | | (3) one reputable member who represents dental |
|---|
| 22 | 22 | | technicians and: |
|---|
| 23 | 23 | | (A) is certified as described by Section |
|---|
| 24 | 24 | | 266.152(a) as a dental technician, resides in this state, and has |
|---|
| 25 | 25 | | been actively engaged in the practice of dental technology for at |
|---|
| 26 | 26 | | least the five years preceding appointment; or |
|---|
| 27 | 27 | | (B) is a dentist who is certified as described by |
|---|
| 28 | 28 | | Section 266.152(a) as a dental technician, resides in this state, |
|---|
| 29 | 29 | | and has been actively engaged in the practice of dentistry and |
|---|
| 30 | 30 | | certified as a dental technician for at least the five years |
|---|
| 31 | 31 | | preceding appointment; and |
|---|
| 32 | 32 | | (4) five members who represent the public. |
|---|
| 33 | 33 | | SECTION 2. Section 252.001, Occupations Code, as amended by |
|---|
| 34 | 34 | | this Act, regarding the qualifications of members of the State |
|---|
| 35 | 35 | | Board of Dental Examiners, does not affect the entitlement of a |
|---|
| 36 | 36 | | dentist member serving on the board immediately before the |
|---|
| 37 | 37 | | effective date of this Act to continue to serve as a member of the |
|---|
| 38 | 38 | | board for the remainder of the member's term. After the term of a |
|---|
| 39 | 39 | | dentist member expires, the governor shall appoint a member who |
|---|
| 40 | 40 | | meets the requirements under Section 252.001(a)(3), Occupations |
|---|
| 41 | 41 | | Code, as amended by this Act. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2015. |
|---|
