55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the membership of the State Board of Dental Examiners.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 252.001(a), Occupations Code, is amended
1010 to read as follows:
1111 (a) The State Board of Dental Examiners consists of 15
1212 members appointed by the governor with the advice and consent of the
1313 senate as follows:
1414 (1) seven [eight] reputable dentist members who reside
1515 in this state and have been actively engaged in the practice of
1616 dentistry for at least the five years preceding appointment;
1717 (2) two reputable dental hygienist members who reside
1818 in this state and have been actively engaged in the practice of
1919 dental hygiene for at least the five years preceding appointment;
2020 [and]
2121 (3) one reputable member who represents dental
2222 technicians and:
2323 (A) is certified as described by Section
2424 266.152(a) as a dental technician, resides in this state, and has
2525 been actively engaged in the practice of dental technology for at
2626 least the five years preceding appointment; or
2727 (B) is a dentist who is certified as described by
2828 Section 266.152(a) as a dental technician, resides in this state,
2929 and has been actively engaged in the practice of dentistry and
3030 certified as a dental technician for at least the five years
3131 preceding appointment; and
3232 (4) five members who represent the public.
3333 SECTION 2. Section 252.001, Occupations Code, as amended by
3434 this Act, regarding the qualifications of members of the State
3535 Board of Dental Examiners, does not affect the entitlement of a
3636 dentist member serving on the board immediately before the
3737 effective date of this Act to continue to serve as a member of the
3838 board for the remainder of the member's term. After the term of a
3939 dentist member expires, the governor shall appoint a member who
4040 meets the requirements under Section 252.001(a)(3), Occupations
4141 Code, as amended by this Act.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2015.
