9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 256.204, Estates Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 256.204. PERIOD FOR CONTEST. (a) After a will is | |
13 | 13 | admitted to probate, an interested person may commence a suit to | |
14 | 14 | contest the validity thereof not later than the first [second] | |
15 | 15 | anniversary of the date the will was admitted to probate, except | |
16 | 16 | that an interested person may commence a suit to cancel a will for | |
17 | 17 | forgery or other fraud not later than the first [second] | |
18 | 18 | anniversary of the date the forgery or fraud was discovered. | |
19 | 19 | (b) Notwithstanding Subsection (a), an incapacitated person | |
20 | 20 | may commence the contest under that subsection on or before the | |
21 | 21 | first [second] anniversary of the date the person's disabilities | |
22 | 22 | are removed. | |
23 | 23 | SECTION 2. The changes in law made by this Act to Section | |
24 | 24 | 256.204, Estates Code, apply only to a will admitted to probate on | |
25 | 25 | or after the effective date of this Act. A will admitted to probate | |
26 | 26 | before the effective date of this Act is governed by the law in | |
27 | 27 | effect on the date on which the will was admitted to probate, and | |
28 | 28 | the former law is continued in effect for that purpose. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2015. |
