| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 260.002, Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 260.002. EXEMPTIONS. (a) This chapter does not apply |
|---|
| 13 | 13 | | to: |
|---|
| 14 | 14 | | (1) a person that is required to be licensed under |
|---|
| 15 | 15 | | Chapter 142, 242, 246, 247, or 252; |
|---|
| 16 | 16 | | (2) a person that is exempt from licensing under |
|---|
| 17 | 17 | | Section 142.003(a)(19), 242.003(3), or 247.004(4); |
|---|
| 18 | 18 | | (3) a hotel as defined by Section 156.001, Tax Code; |
|---|
| 19 | 19 | | (4) a retirement community; |
|---|
| 20 | 20 | | (5) a monastery or convent; |
|---|
| 21 | 21 | | (6) a child-care facility as defined by Section |
|---|
| 22 | 22 | | 42.002, Human Resources Code; |
|---|
| 23 | 23 | | (7) a family violence shelter center as defined by |
|---|
| 24 | 24 | | Section 51.002, Human Resources Code; [or] |
|---|
| 25 | 25 | | (8) a sorority or fraternity house or other dormitory |
|---|
| 26 | 26 | | associated with an institution of higher education; or |
|---|
| 27 | 27 | | (9) an alcohol- and drug-free recovery home. |
|---|
| 28 | 28 | | (b) The executive commissioner by rule shall develop |
|---|
| 29 | 29 | | criteria for establishing whether an entity is an alcohol- and |
|---|
| 30 | 30 | | drug-free recovery home. In developing the criteria, the executive |
|---|
| 31 | 31 | | commissioner shall consult with the National Alliance for Recovery |
|---|
| 32 | 32 | | Residences, the Texas Recovery Oriented Housing Network, and other |
|---|
| 33 | 33 | | interested organizations. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2015. |
