66 AN ACT
77 relating to entities exempt from regulation as a boarding home
88 facility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 260.002, Health and Safety Code, is
1111 amended to read as follows:
1212 Sec. 260.002. EXEMPTIONS. (a) This chapter does not apply
1313 to:
1414 (1) a person that is required to be licensed under
1515 Chapter 142, 242, 246, 247, or 252;
1616 (2) a person that is exempt from licensing under
1717 Section 142.003(a)(19), 242.003(3), or 247.004(4);
1818 (3) a hotel as defined by Section 156.001, Tax Code;
1919 (4) a retirement community;
2020 (5) a monastery or convent;
2121 (6) a child-care facility as defined by Section
2222 42.002, Human Resources Code;
2323 (7) a family violence shelter center as defined by
2424 Section 51.002, Human Resources Code; [or]
2525 (8) a sorority or fraternity house or other dormitory
2626 associated with an institution of higher education; or
2727 (9) an alcohol- and drug-free recovery home.
2828 (b) The executive commissioner by rule shall develop
2929 criteria for establishing whether an entity is an alcohol- and
3030 drug-free recovery home. In developing the criteria, the executive
3131 commissioner shall consult with the National Alliance for Recovery
3232 Residences, the Texas Recovery Oriented Housing Network, and other
3333 interested organizations.
3434 SECTION 2. This Act takes effect September 1, 2015.
