11 | 5 | | relating to eliminating telegraph transmission as a method to |

12 | 6 | | communicate certain information in a criminal case. |

13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
14 | 8 | | SECTION 1. Article 15.08, Code of Criminal Procedure, is |
---|
15 | 9 | | amended to read as follows: |
---|
16 | 10 | | Art. 15.08. WARRANT MAY BE FORWARDED. A warrant of arrest |
---|
17 | 11 | | may be forwarded by any method that ensures the transmission of a |
---|
18 | 12 | | duplicate of the original warrant, including secure facsimile |
---|
19 | 13 | | transmission or other secure electronic means [or a telegraph |
---|
20 | 14 | | transmission from any telegraph office to another in this State]. |
---|
21 | 15 | | If issued by any magistrate named in Article 15.06, the peace |
---|
22 | 16 | | officer receiving the same shall execute it without delay. If it be |
---|
23 | 17 | | issued by any other magistrate than is named in Article 15.06, the |
---|
24 | 18 | | peace officer receiving the same shall proceed with it to the |
---|
25 | 19 | | nearest magistrate of the peace officer's county, who shall endorse |
---|
26 | 20 | | thereon, in substance, these words: |
---|
27 | 21 | | "Let this warrant be executed in the county of |
---|
28 | 22 | | . . . . . . . . . . .", which endorsement shall be dated and |
---|
29 | 23 | | signed officially by the magistrate making the same. |
---|
30 | 24 | | SECTION 2. Article 15.19(a), Code of Criminal Procedure, is |
---|
31 | 25 | | amended to read as follows: |
---|
32 | 26 | | (a) If the arrested person fails or refuses to give bail, as |
---|
33 | 27 | | provided in Article 15.18, the arrested person shall be committed |
---|
34 | 28 | | to the jail of the county where the person was arrested. The[; and |
---|
35 | 29 | | the] magistrate committing the arrested person shall immediately |
---|
36 | 30 | | provide notice to the sheriff of the county in which the offense is |
---|
37 | 31 | | alleged to have been committed regarding: |
---|
38 | 32 | | (1) the arrest and commitment, which notice may be |
---|
39 | 33 | | given by [telegraph,] mail[,] or other written means or by secure |
---|
40 | 34 | | facsimile transmission or other secure electronic means; and |
---|
41 | 35 | | (2) whether the person was also arrested under a |
---|
42 | 36 | | warrant issued under Section 508.251, Government Code. |

43 | 37 | | SECTION 3. Articles 15.10, 15.11, 15.12, and 15.13, Code of |
---|
44 | 38 | | Criminal Procedure, are repealed. |
---|
45 | 39 | | SECTION 4. This Act takes effect September 1, 2015. |
