104 AN ACT
115 relating to eliminating telegraph transmission as a method to
126 communicate certain information in a criminal case.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Article 15.08, Code of Criminal Procedure, is
159 amended to read as follows:
1610 Art. 15.08. WARRANT MAY BE FORWARDED. A warrant of arrest
1711 may be forwarded by any method that ensures the transmission of a
1812 duplicate of the original warrant, including secure facsimile
1913 transmission or other secure electronic means [or a telegraph
2014 transmission from any telegraph office to another in this State].
2115 If issued by any magistrate named in Article 15.06, the peace
2216 officer receiving the same shall execute it without delay. If it be
2317 issued by any other magistrate than is named in Article 15.06, the
2418 peace officer receiving the same shall proceed with it to the
2519 nearest magistrate of the peace officer's county, who shall endorse
2620 thereon, in substance, these words:
2721 "Let this warrant be executed in the county of
2822 . . . . . . . . . . .", which endorsement shall be dated and
2923 signed officially by the magistrate making the same.
3024 SECTION 2. Article 15.19(a), Code of Criminal Procedure, is
3125 amended to read as follows:
3226 (a) If the arrested person fails or refuses to give bail, as
3327 provided in Article 15.18, the arrested person shall be committed
3428 to the jail of the county where the person was arrested. The[; and
3529 the] magistrate committing the arrested person shall immediately
3630 provide notice to the sheriff of the county in which the offense is
3731 alleged to have been committed regarding:
3832 (1) the arrest and commitment, which notice may be
3933 given by [telegraph,] mail[,] or other written means or by secure
4034 facsimile transmission or other secure electronic means; and
4135 (2) whether the person was also arrested under a
4236 warrant issued under Section 508.251, Government Code.
4337 SECTION 3. Articles 15.10, 15.11, 15.12, and 15.13, Code of
4438 Criminal Procedure, are repealed.
4539 SECTION 4. This Act takes effect September 1, 2015.
