66 AN ACT
77 relating to abolishing the regulation of hair braiding.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1601.002, Occupations Code, is amended
1010 to read as follows:
1111 Sec. 1601.002. DEFINITION OF BARBERING. In this chapter,
1212 "barbering," "practicing barbering," or the "practice of
1313 barbering" means:
1414 (1) performing or offering or attempting to perform
1515 for compensation or the promise of compensation any of the
1616 following services:
1717 (A) treating a person's mustache or beard by
1818 arranging, beautifying, coloring, processing, shaving, styling, or
1919 trimming;
2020 (B) treating a person's hair by:
2121 (i) arranging, beautifying, bleaching,
2222 cleansing, coloring, curling, dressing, dyeing, processing,
2323 shampooing, shaping, singeing, straightening, styling, tinting, or
2424 waving;
2525 (ii) providing a necessary service that is
2626 preparatory or ancillary to a service under Subparagraph (i),
2727 including bobbing, clipping, cutting, or trimming; or
2828 (iii) cutting the person's hair as a
2929 separate and independent service for which a charge is directly or
3030 indirectly made separately from a charge for any other service;
3131 (C) cleansing, stimulating, or massaging a
3232 person's scalp, face, neck, arms, or shoulders:
3333 (i) by hand or by using a device, apparatus,
3434 or appliance; and
3535 (ii) with or without the use of any cosmetic
3636 preparation, antiseptic, tonic, lotion, or cream;
3737 (D) beautifying a person's face, neck, arms, or
3838 shoulders using a cosmetic preparation, antiseptic, tonic, lotion,
3939 powder, oil, clay, cream, or appliance;
4040 (E) treating a person's nails by:
4141 (i) cutting, trimming, polishing, tinting,
4242 coloring, cleansing, manicuring, or pedicuring; or
4343 (ii) attaching false nails;
4444 (F) massaging, cleansing, treating, or
4545 beautifying a person's hands;
4646 (G) administering facial treatments;
4747 (H) weaving a person's hair by using any method
4848 to attach commercial hair to a person's hair or scalp;
4949 (I) shampooing or conditioning a person's hair;
5050 or
5151 (J) servicing in any manner listed in Paragraph
5252 (B) a person's wig, toupee, or artificial hairpiece on a person's
5353 head or on a block after the initial retail sale; [or
5454 [(K) braiding a person's hair, trimming hair
5555 extensions only as applicable to the braiding process, and
5656 attaching commercial hair only by braiding and without the use of
5757 chemicals or adhesives;]
5858 (2) advertising or representing to the public in any
5959 manner that a person is a barber or is authorized to practice
6060 barbering; or
6161 (3) advertising or representing to the public in any
6262 manner that a location or place of business is a barbershop,
6363 specialty shop, or barber school.
6464 SECTION 2. Section 1601.254(c), Occupations Code, is
6565 amended to read as follows:
6666 (c) The commission shall adopt rules for the licensing of
6767 specialty instructors to teach specialty courses in the practice of
6868 barbering as defined by Sections 1601.002(1)(C)-(H) [and (K)].
6969 SECTION 3. Section 1601.304(a), Occupations Code, is
7070 amended to read as follows:
7171 (a) A person who holds a specialty shop permit may maintain
7272 an establishment in which only barbering as defined by Section
7373 1601.002(1)(E), (F), or (H)[, or (K)] is performed.
7474 SECTION 4. Section 1602.002(a), Occupations Code, is
7575 amended to read as follows:
7676 (a) In this chapter, "cosmetology" means the practice of
7777 performing or offering to perform for compensation any of the
7878 following services:
7979 (1) treating a person's hair by:
8080 (A) providing any method of treatment as a
8181 primary service, including arranging, beautifying, bleaching,
8282 cleansing, coloring, cutting, dressing, dyeing, processing,
8383 shampooing, shaping, singeing, straightening, styling, tinting, or
8484 waving;
8585 (B) providing a necessary service that is
8686 preparatory or ancillary to a service under Paragraph (A),
8787 including bobbing, clipping, cutting, or trimming a person's hair
8888 or shaving a person's neck with a safety razor; or
8989 (C) cutting the person's hair as a separate and
9090 independent service for which a charge is directly or indirectly
9191 made separately from charges for any other service;
9292 (2) [braiding a person's hair;
9393 [(3)] shampooing and conditioning a person's hair;
9494 (3) [(4)] servicing a person's wig or artificial
9595 hairpiece on a person's head or on a block after the initial retail
9696 sale and servicing in any manner listed in Subdivision (1);
9797 (4) [(5)] treating a person's mustache or beard by
9898 arranging, beautifying, coloring, processing, styling, trimming,
9999 or shaving with a safety razor;
100100 (5) [(6)] cleansing, stimulating, or massaging a
101101 person's scalp, face, neck, or arms:
102102 (A) by hand or by using a device, apparatus, or
103103 appliance; and
104104 (B) with or without the use of any cosmetic
105105 preparation, antiseptic, tonic, lotion, or cream;
106106 (6) [(7)] beautifying a person's face, neck, or arms
107107 using a cosmetic preparation, antiseptic, tonic, lotion, powder,
108108 oil, clay, cream, or appliance;
109109 (7) [(8)] administering facial treatments;
110110 (8) [(9)] removing superfluous hair from a person's
111111 body using depilatories, preparations, or tweezing techniques;
112112 (9) [(10)] treating a person's nails by:
113113 (A) cutting, trimming, polishing, tinting,
114114 coloring, cleansing, or manicuring; or
115115 (B) attaching false nails;
116116 (10) [(11)] massaging, cleansing, treating, or
117117 beautifying a person's hands or feet;
118118 (11) [(12)] applying semipermanent, thread-like
119119 extensions composed of single fibers to a person's eyelashes; or
120120 (12) [(13)] weaving a person's hair.
121121 SECTION 5. Section 1602.255(c), Occupations Code, is
122122 amended to read as follows:
123123 (c) The commission shall adopt rules for the licensing of
124124 specialty instructors to teach specialty courses in the practice of
125125 cosmetology defined in Sections 1602.002(a)(6), (8), (9), and (11)
126126 [1602.002(a)(7), (9), (10), and (12)].
127127 SECTION 6. Section 1602.256(a), Occupations Code, is
128128 amended to read as follows:
129129 (a) A person holding a manicurist specialty license may
130130 perform only the practice of cosmetology defined in Section
131131 1602.002(a)(9) or (10) [1602.002(a)(10) or (11)].
132132 SECTION 7. Section 1602.257(a), Occupations Code, is
133133 amended to read as follows:
134134 (a) A person holding an esthetician specialty license may
135135 perform only the practice of cosmetology defined in Sections
136136 1602.002(a)(5), (6), (7), (8), and (11) [1602.002(a)(6), (7), (8),
137137 (9), and (12)].
138138 SECTION 8. Section 1602.2571(a), Occupations Code, is
139139 amended to read as follows:
140140 (a) A person holding a specialty license in eyelash
141141 extension application may perform only the practice of cosmetology
142142 defined in Section 1602.002(a)(11) [1602.002(a)(12)].
143143 SECTION 9. Section 1602.259(a), Occupations Code, is
144144 amended to read as follows:
145145 (a) A person holding a hair weaving specialty certificate
146146 may perform only the practice of cosmetology defined in Sections
147147 1602.002(a)(2)[, (3),] and (12) [(13)].
148148 SECTION 10. Section 1602.260(a), Occupations Code, is
149149 amended to read as follows:
150150 (a) A person holding a wig specialty certificate may perform
151151 only the practice of cosmetology defined in Section 1602.002(a)(3)
152152 [1602.002(a)(4)].
153153 SECTION 11. Section 1602.261(a), Occupations Code, is
154154 amended to read as follows:
155155 (a) A person holding a manicurist/esthetician specialty
156156 license may perform only the practice of cosmetology defined in
157157 Sections 1602.002(a)(5) through (10) [1602.002(a)(6) through
158158 (11)].
159159 SECTION 12. Section 1602.267(a), Occupations Code, is
160160 amended to read as follows:
161161 (a) A person holding a shampoo apprentice permit may perform
162162 only the practice of cosmetology defined by Section 1602.002(a)(2)
163163 [1602.002(3)].
164164 SECTION 13. Section 1602.305(a), Occupations Code, is
165165 amended to read as follows:
166166 (a) A person holding a specialty shop license may maintain
167167 an establishment in which only the practice of cosmetology as
168168 defined in Section 1602.002(a)(3), (6), (8) [1602.002(a)(2), (4),
169169 (7)], (9), [(10),] or (11) [(12)] is performed.
170170 SECTION 14. Section 1603.352(a), Occupations Code, is
171171 amended to read as follows:
172172 (a) A person who holds a license, certificate, or permit
173173 issued under this chapter, Chapter 1601, or Chapter 1602 and who
174174 performs a barbering service described by Section 1601.002(1)(E) or
175175 (F) or a cosmetology service described by Section 1602.002(a)(9) or
176176 (10) [1602.002(a)(10) or (11)] shall, before performing the
177177 service, clean, disinfect, and sterilize with an autoclave or dry
178178 heat sterilizer or sanitize with an ultraviolet sanitizer, in
179179 accordance with the sterilizer or sanitizer manufacturer's
180180 instructions, each metal instrument, including metal nail
181181 clippers, cuticle pushers, cuticle nippers, and other metal
182182 instruments, used to perform the service.
183183 SECTION 15. Sections 1601.259 and 1602.258, Occupations
184184 Code, are repealed.
185185 SECTION 16. (a) On the effective date of this Act:
186186 (1) a disciplinary proceeding pending before the Texas
187187 Department of Licensing and Regulation relating to an allegation
188188 against a person for practicing, without the appropriate
189189 certificate, barbering as defined by Section 1601.002(1)(K),
190190 Occupations Code, or cosmetology as defined by Section
191191 1602.002(a)(2), Occupations Code, as those sections existed
192192 immediately before the effective date of this Act, is dismissed;
193193 and
194194 (2) a hair braiding specialty certificate issued under
195195 former Section 1601.259 or 1602.258, Occupations Code, expires.
196196 (b) As soon as practicable after the effective date of this
197197 Act, the Texas Department of Licensing and Regulation shall issue a
198198 prorated refund of any fees paid by a holder of a hair braiding
199199 specialty certificate under former Section 1601.259 or 1602.258,
200200 Occupations Code, that was scheduled to expire after the effective
201201 date of this Act.
202202 (c) As soon as practicable after the effective date of this
203203 Act, the Texas Commission of Licensing and Regulation shall repeal
204204 all rules regarding the regulation of hair braiding and the
205205 teaching of hair braiding.
206206 SECTION 17. This Act takes effect September 1, 2015.
