9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 779, Health and Safety Code, is amended | |
11 | 11 | by adding Section 779.0061 to read as follows: | |
12 | 12 | Sec. 779.0061. DUTY TO USE AUTOMATED EXTERNAL | |
13 | 13 | DEFIBRILLATOR; CIVIL LIABILITY. (a) A business entity that | |
14 | 14 | advertises the presence of an automated external defibrillator and | |
15 | 15 | staff trained to use the automated external defibrillator shall use | |
16 | 16 | the automated external defibrillator on a person in cardiac arrest | |
17 | 17 | on property owned or rented by the business entity if necessary. | |
18 | 18 | (b) If a business entity negligently fails to use an | |
19 | 19 | automated external defibrillator under Subsection (a), the | |
20 | 20 | business entity is liable for civil damages, including personal | |
21 | 21 | injury and wrongful death, caused by the negligent failure to act. | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2015. |
