66 AN ACT
77 relating to the duty of business entities to use an automated
88 external defibrillator.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 779, Health and Safety Code, is amended
1111 by adding Section 779.0061 to read as follows:
1212 Sec. 779.0061. DUTY TO USE AUTOMATED EXTERNAL
1313 DEFIBRILLATOR; CIVIL LIABILITY. (a) A business entity that
1414 advertises the presence of an automated external defibrillator and
1515 staff trained to use the automated external defibrillator shall use
1616 the automated external defibrillator on a person in cardiac arrest
1717 on property owned or rented by the business entity if necessary.
1818 (b) If a business entity negligently fails to use an
1919 automated external defibrillator under Subsection (a), the
2020 business entity is liable for civil damages, including personal
2121 injury and wrongful death, caused by the negligent failure to act.
2222 SECTION 2. This Act takes effect September 1, 2015.
