| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 30A.002(b), Education Code, is amended | |
| 12 | 12 | to read as follows: | |
| 13 | 13 | (b) A student is eligible to enroll full-time in courses | |
| 14 | 14 | provided through the state virtual school network only if the | |
| 15 | 15 | student: | |
| 16 | 16 | (1) was enrolled in a public school [in this state] in | |
| 17 | 17 | the preceding school year; or | |
| 18 | 18 | (2) has been placed in substitute care in this state, | |
| 19 | 19 | regardless of whether the student was enrolled in a public school | |
| 20 | 20 | [in this state] in the preceding school year. | |
| 21 | 21 | SECTION 2. This Act applies beginning with the 2015-2016 | |
| 22 | 22 | school year. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2015. |
