66 AN ACT
77 relating to a permanent request for an early voting ballot.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 86.0015(a) and (b), Election Code, are
1010 amended to read as follows:
1111 (a) This section applies only to an application for a ballot
1212 to be voted by mail that[:
1313 [(1)] is submitted to the county clerk indicating the
1414 ground of eligibility is age, [or] disability, or absence from
1515 county of residence [; and
1616 [(2) does not specify the election for which a ballot
1717 is requested].
1818 (b) An application described by Subsection (a) is
1919 considered to be an application for a ballot for each election in
2020 which the county clerk serves as early voting clerk and:
2121 (1) in which the applicant is eligible to vote; and
2222 (2) that occurs before the earlier of the date:
2323 (A) [the end of the calendar year in which the
2424 application was submitted; or
2525 [(B) the date] the county clerk receives notice
2626 from the voter registrar under Subsection (d) that the voter has
2727 submitted a change in registration information; or
2828 (B) the voter is no longer eligible for early
2929 voting by mail under Section 82.001, if the voter became eligible
3030 under that section.
3131 SECTION 2. The change in law made by this Act applies only
3232 to an application for a ballot to be voted by mail received on or
3333 after the effective date of this Act.
3434 SECTION 3. This Act takes effect January 1, 2016.
