| 8 | 8 | | to vote an early ballot by mail. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 84.007(c), Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (c) An application may [must] be submitted at any time in |
|---|
| 13 | 13 | | the year preceding the date of the election for which a ballot is |
|---|
| 14 | 14 | | requested, but not later than [on or after the 60th day before |
|---|
| 15 | 15 | | election day and before] the close of regular business in the early |
|---|
| 16 | 16 | | voting clerk's office or 12 noon, whichever is later, on the ninth |
|---|
| 17 | 17 | | day before election day unless that day is a Saturday, Sunday, or |
|---|
| 18 | 18 | | legal state or national holiday, in which case the last day is the |
|---|
| 19 | 19 | | first preceding regular business day. |

| 20 | 20 | | SECTION 2. Section 84.009, Election Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | Sec. 84.009. SUBMITTING APPLICATION FOR BALLOT VOTED BY |
|---|
| 23 | 23 | | MAIL: CONFINEMENT IN JAIL. [(a)] On request of the applicant, an |
|---|
| 24 | 24 | | application for a ballot to be voted by mail on the ground of |
|---|
| 25 | 25 | | confinement in jail may be submitted to the early voting clerk, at |
|---|
| 26 | 26 | | the discretion of the authority in charge of the jail, by personal |
|---|
| 27 | 27 | | delivery by the jail authority or by a designated subordinate of the |
|---|
| 28 | 28 | | authority. |
|---|
| 29 | 29 | | [(b) An application submitted under this section may not be |
|---|
| 30 | 30 | | submitted before the 20th day before election day.] |
|---|
| 31 | 31 | | SECTION 3. Section 101.052(b), Election Code, is amended to |
|---|
| 32 | 32 | | read as follows: |
|---|
| 33 | 33 | | (b) A federal postcard application may be submitted at any |
|---|
| 34 | 34 | | time during the [calendar] year preceding the date of [in which] the |
|---|
| 35 | 35 | | election for which a ballot is requested [occurs], but not later |
|---|
| 36 | 36 | | than the deadline for submitting a regular application for a ballot |
|---|
| 37 | 37 | | to be voted by mail. |
|---|
| 38 | 38 | | SECTION 4. Section 101.052(c), Election Code, is repealed. |
|---|
| 39 | 39 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2015. |
