77 relating to the period in which a person may submit an application
88 to vote an early ballot by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 84.007(c), Election Code, is amended to
1111 read as follows:
1212 (c) An application may [must] be submitted at any time in
1313 the year preceding the date of the election for which a ballot is
1414 requested, but not later than [on or after the 60th day before
1515 election day and before] the close of regular business in the early
1616 voting clerk's office or 12 noon, whichever is later, on the ninth
1717 day before election day unless that day is a Saturday, Sunday, or
1818 legal state or national holiday, in which case the last day is the
1919 first preceding regular business day.
2020 SECTION 2. Section 84.009, Election Code, is amended to
2121 read as follows:
2222 Sec. 84.009. SUBMITTING APPLICATION FOR BALLOT VOTED BY
2323 MAIL: CONFINEMENT IN JAIL. [(a)] On request of the applicant, an
2424 application for a ballot to be voted by mail on the ground of
2525 confinement in jail may be submitted to the early voting clerk, at
2626 the discretion of the authority in charge of the jail, by personal
2727 delivery by the jail authority or by a designated subordinate of the
2828 authority.
2929 [(b) An application submitted under this section may not be
3030 submitted before the 20th day before election day.]
3131 SECTION 3. Section 101.052(b), Election Code, is amended to
3232 read as follows:
3333 (b) A federal postcard application may be submitted at any
3434 time during the [calendar] year preceding the date of [in which] the
3535 election for which a ballot is requested [occurs], but not later
3636 than the deadline for submitting a regular application for a ballot
3737 to be voted by mail.
3838 SECTION 4. Section 101.052(c), Election Code, is repealed.
3939 SECTION 5. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2015.
