66 AN ACT
77 relating to a voter's use of an application for a ballot to be voted
88 by mail to update the voter's residence.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 84.002, Election Code, is amended by
1111 adding Subsection (c) to read as follows:
1212 (c) An application for a ballot to be voted by mail may
1313 indicate a change of residence address. If the voter includes a
1414 change of residence address in the voter's application, the early
1515 voting clerk shall notify the appropriate voter registrars of the
1616 change and the registrars shall update the voter's voter
1717 registration information accordingly.
1818 SECTION 2. Section 84.011, Election Code, is amended by
1919 adding Subsection (c) to read as follows:
2020 (c) The officially prescribed application form for an early
2121 voting ballot to be voted by mail must include a space for the voter
2222 to provide a change of residence address.
2323 SECTION 3. Section 86.001(e), Election Code, is amended to
2424 read as follows:
2525 (e) If the applicant does not have an effective voter
2626 registration for the election, the clerk shall reject the
2727 application unless:
2828 (1) the clerk can determine from the voter registrar
2929 that the applicant has submitted a voter registration application
3030 and the registration will be effective on election day; or
3131 (2) the voter has provided a change of residence
3232 address on the voter's application for a ballot to be voted by mail
3333 and the voter's registration will be effective on election day.
3434 SECTION 4. This Act takes effect September 1, 2015.
