15 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 8 | | SECTION 1. Section 753.004, Health and Safety Code, is |
---|
17 | 9 | | amended by amending Subsections (d) and (e) and adding Subsection |
---|
18 | 10 | | (d-1) to read as follows: |
---|
19 | 11 | | (d) Except as provided by Subsection (d-1), gasoline |
---|
20 | 12 | | [Gasoline], diesel fuel, or kerosene may be stored in an |
---|
21 | 13 | | aboveground storage tank [with a capacity of not more than 4,000 |
---|
22 | 14 | | gallons] at a retail service station located in an unincorporated |
---|
23 | 15 | | area or in a municipality with a population of less than 5,000. |
---|
24 | 16 | | (d-1) A commissioners court of a county with a population of |
---|
25 | 17 | | 3.3 million or more may by order limit the maximum volume of an |
---|
26 | 18 | | aboveground storage tank in an unincorporated area of the county in |
---|
27 | 19 | | accordance with the county fire code. |
---|
28 | 20 | | (e) Under Subsection (d), a retail service station may have |
---|
29 | 21 | | a tank [not exceeding the specified capacity] for each separate |
---|
30 | 22 | | grade of gasoline, diesel fuel, or kerosene, but may not have more |
---|
31 | 23 | | than one tank [of that capacity] for the same grade. |
---|
32 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
---|
33 | 25 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 27 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 28 | | Act takes effect September 1, 2015. |
