11	4		AN ACT
12	5		relating to eliminating requirements that certain public
13	6		institutions of higher education set aside portions of tuition for
14	7		student loan repayment programs for certain physicians and state
15	8		attorneys.
16	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
17	10		SECTION 1. Section 61.5391(a), Education Code, is amended
18	11		to read as follows:
19	12		(a) The physician education loan repayment program account
20	13		is an account in the general revenue fund. The account is composed
21	14		of:
22	15		(1) gifts and grants contributed to the account;
23	16		(2) earnings on the principal of the account; and
24	17		(3) other amounts deposited to the credit of the
25	18		account, including:
26	19		(A) money deposited under Section [61.539(b) or]
27	20		61.5392;
28	21		(B) legislative appropriations; and
29	22		(C) money deposited under Section 155.2415, Tax
30	23		Code.
31	24		SECTION 2. Sections 61.9730 and 61.9732, Education Code,
32	25		are amended to read as follows:
33	26		Sec. 61.9730. TOTAL AMOUNT OF REPAYMENT ASSISTANCE. The
34	27		total amount of repayment assistance distributed by the board under
35	28		this subchapter may not exceed the total amount available for the
36	29		program under Section 61.9732 [of gifts, grants, and donations
37	30		accepted by the board for repayment assistance and tuition set
38	31		aside under Section 61.9731].
39	32		Sec. 61.9732. LIMITATIONS ON FUNDING. The loan repayment
40	33		program under this subchapter may be funded only from:
41	34		(1) gifts, grants, and donations accepted by the
42	35		board; [and]
43	36		(2) legislative appropriations for the program; and
44	37		(3) money budgeted for the program by the office of the
45	38		attorney general from appropriations made to that office [tuition
46	39		set aside under Section 61.9731].
47	40		SECTION 3. The following provisions of the Education Code
48	41		are repealed:
49	42		(1) Section 61.539; and
50	43		(2) Section 61.9731.
51	44		SECTION 4. (a) The change in law made by this Act applies
52	45		beginning with tuition charged for the 2015 fall semester.
53	46		(b) Tuition charged for any semester or other academic term
54	47		before the 2015 fall semester is covered by the applicable law as it
55	48		existed before the effective date of this Act, and the former law is
56	49		continued in effect for that purpose.
57	50		SECTION 5. This Act takes effect immediately if it receives
58	51		a vote of two-thirds of all the members elected to each house, as
59	52		provided by Section 39, Article III, Texas Constitution. If this
60	53		Act does not receive the vote necessary for immediate effect, this
61	54		Act takes effect September 1, 2015.
