205 relating to the powers of the Crosswinds Municipal Utility
216 District; providing authority to issue bonds for road projects.
227 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
238 SECTION 1. Section 8468.005(b), Special District Local Laws
249 Code, is amended to read as follows:
2510 (b) The district is created to accomplish the purposes of:
2611 (1) a municipal utility district as provided by
2712 general law and Section 59, Article XVI, Texas Constitution; and
2813 (2) Section 52, Article III, Texas Constitution, that
2914 relate to the construction, acquisition, improvement, operation,
3015 or maintenance of macadamized, graveled, or paved roads, or
3116 improvements, including storm drainage, in aid of those roads.
3217 SECTION 2. Subchapter C, Chapter 8468, Special District
3318 Local Laws Code, is amended by adding Sections 8468.104 and
3419 8468.105 to read as follows:
3520 Sec. 8468.104. AUTHORITY FOR ROAD PROJECTS. Under Section
3621 52, Article III, Texas Constitution, the district may design,
3722 acquire, construct, finance, issue bonds for, improve, operate,
3823 maintain, and convey to this state, a county, or a municipality for
3924 operation and maintenance macadamized, graveled, or paved roads, or
4025 improvements, including storm drainage, in aid of those roads.
4126 Sec. 8468.105. ROAD STANDARDS AND REQUIREMENTS. (a) A road
4227 project must meet all applicable construction standards, zoning and
4328 subdivision requirements, and regulations of each municipality in
4429 whose corporate limits or extraterritorial jurisdiction the road
4530 project is located.
4631 (b) If a road project is not located in the corporate limits
4732 or extraterritorial jurisdiction of a municipality, the road
4833 project must meet all applicable construction standards,
4934 subdivision requirements, and regulations of each county in which
5035 the road project is located.
5136 (c) If the state will maintain and operate the road, the
5237 Texas Transportation Commission must approve the plans and
5338 specifications of the road project.
5439 SECTION 3. Section 8468.151, Special District Local Laws
5540 Code, is amended by adding Subsection (c) to read as follows:
5641 (c) The district may not issue bonds payable from ad valorem
5742 taxes to finance a road project unless the issuance is approved by a
5843 vote of a two-thirds majority of the district voters voting at an
5944 election held for that purpose.
6045 SECTION 4. Subchapter E, Chapter 8468, Special District
6146 Local Laws Code, is amended by adding Section 8468.203 to read as
6247 follows:
6348 Sec. 8468.203. BONDS FOR ROAD PROJECTS. At the time of
6449 issuance, the total principal amount of bonds or other obligations
6550 issued or incurred to finance road projects and payable from ad
6651 valorem taxes may not exceed one-fourth of the assessed value of the
6752 real property in the district.
6853 SECTION 5. This Act takes effect immediately if it receives
6954 a vote of two-thirds of all the members elected to each house, as
7055 provided by Section 39, Article III, Texas Constitution. If this
7156 Act does not receive the vote necessary for immediate effect, this
7257 Act takes effect September 1, 2015.
