20	5		relating to the powers of the Crosswinds Municipal Utility
21	6		District; providing authority to issue bonds for road projects.
22	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
23	8		SECTION 1. Section 8468.005(b), Special District Local Laws
24	9		Code, is amended to read as follows:
25	10		(b) The district is created to accomplish the purposes of:
26	11		(1) a municipal utility district as provided by
27	12		general law and Section 59, Article XVI, Texas Constitution; and
28	13		(2) Section 52, Article III, Texas Constitution, that
29	14		relate to the construction, acquisition, improvement, operation,
30	15		or maintenance of macadamized, graveled, or paved roads, or
31	16		improvements, including storm drainage, in aid of those roads.
32	17		SECTION 2. Subchapter C, Chapter 8468, Special District
33	18		Local Laws Code, is amended by adding Sections 8468.104 and
34	19		8468.105 to read as follows:
35	20		Sec. 8468.104. AUTHORITY FOR ROAD PROJECTS. Under Section
36	21		52, Article III, Texas Constitution, the district may design,
37	22		acquire, construct, finance, issue bonds for, improve, operate,
38	23		maintain, and convey to this state, a county, or a municipality for
39	24		operation and maintenance macadamized, graveled, or paved roads, or
40	25		improvements, including storm drainage, in aid of those roads.
41	26		Sec. 8468.105. ROAD STANDARDS AND REQUIREMENTS. (a) A road
42	27		project must meet all applicable construction standards, zoning and
43	28		subdivision requirements, and regulations of each municipality in
44	29		whose corporate limits or extraterritorial jurisdiction the road
45	30		project is located.
46	31		(b) If a road project is not located in the corporate limits
47	32		or extraterritorial jurisdiction of a municipality, the road
48	33		project must meet all applicable construction standards,
49	34		subdivision requirements, and regulations of each county in which
50	35		the road project is located.
51	36		(c) If the state will maintain and operate the road, the
52	37		Texas Transportation Commission must approve the plans and
53	38		specifications of the road project.
54	39		SECTION 3. Section 8468.151, Special District Local Laws
55	40		Code, is amended by adding Subsection (c) to read as follows:
56	41		(c) The district may not issue bonds payable from ad valorem
57	42		taxes to finance a road project unless the issuance is approved by a
58	43		vote of a two-thirds majority of the district voters voting at an
59	44		election held for that purpose.
60	45		SECTION 4. Subchapter E, Chapter 8468, Special District
61	46		Local Laws Code, is amended by adding Section 8468.203 to read as
62	47		follows:
63	48		Sec. 8468.203. BONDS FOR ROAD PROJECTS. At the time of
64	49		issuance, the total principal amount of bonds or other obligations
65	50		issued or incurred to finance road projects and payable from ad
66	51		valorem taxes may not exceed one-fourth of the assessed value of the
67	52		real property in the district.
68	53		SECTION 5. This Act takes effect immediately if it receives
69	54		a vote of two-thirds of all the members elected to each house, as
70	55		provided by Section 39, Article III, Texas Constitution. If this
71	56		Act does not receive the vote necessary for immediate effect, this
72	57		Act takes effect September 1, 2015.
