9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 17, Civil Practice and |
---|
11 | 11 | | Remedies Code, is amended by adding Section 17.032 to read as |
---|
12 | 12 | | follows: |

13 | 13 | | Sec. 17.032. SUBSTITUTED SERVICE THROUGH SOCIAL MEDIA |
---|
14 | 14 | | PRESENCE. (a) If substituted service of citation is authorized |
---|
15 | 15 | | under the Texas Rules of Civil Procedure, the court, in accordance |
---|
16 | 16 | | with the rules adopted by the supreme court under Subsection (b), |
---|
17 | 17 | | may prescribe as a method of service an electronic communication |
---|
18 | 18 | | sent to the defendant through a social media presence. |
---|
19 | 19 | | (b) The supreme court shall adopt rules to provide for the |
---|
20 | 20 | | substituted service of citation by an electronic communication sent |
---|
21 | 21 | | to a defendant through a social media presence. |
---|
22 | 22 | | SECTION 2. The Supreme Court of Texas shall adopt rules |
---|
23 | 23 | | under Section 17.032, Civil Practice and Remedies Code, as added by |
---|
24 | 24 | | this Act, not later than December 31, 2015. |
---|
25 | 25 | | SECTION 3. Section 17.032, Civil Practice and Remedies |
---|
26 | 26 | | Code, as added by this Act, applies only to an action commenced on |
---|
27 | 27 | | or after the effective date of the rules adopted by the Supreme |
---|
28 | 28 | | Court of Texas under that section. |
---|
29 | 29 | | SECTION 4. This Act takes effect September 1, 2015. |
