99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 17, Civil Practice and
1111 Remedies Code, is amended by adding Section 17.032 to read as
1212 follows:
1313 Sec. 17.032. SUBSTITUTED SERVICE THROUGH SOCIAL MEDIA
1414 PRESENCE. (a) If substituted service of citation is authorized
1515 under the Texas Rules of Civil Procedure, the court, in accordance
1616 with the rules adopted by the supreme court under Subsection (b),
1717 may prescribe as a method of service an electronic communication
1818 sent to the defendant through a social media presence.
1919 (b) The supreme court shall adopt rules to provide for the
2020 substituted service of citation by an electronic communication sent
2121 to a defendant through a social media presence.
2222 SECTION 2. The Supreme Court of Texas shall adopt rules
2323 under Section 17.032, Civil Practice and Remedies Code, as added by
2424 this Act, not later than December 31, 2015.
2525 SECTION 3. Section 17.032, Civil Practice and Remedies
2626 Code, as added by this Act, applies only to an action commenced on
2727 or after the effective date of the rules adopted by the Supreme
2828 Court of Texas under that section.
2929 SECTION 4. This Act takes effect September 1, 2015.
