55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the acquisition and use by a school district of an
88 electroencephalogram brain assessment platform to monitor
99 concussions in student athletes.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 38, Education Code, is
1212 amended by adding Section 38.1581 to read as follows:
1313 Sec. 38.1581. MONITORING CONCUSSIONS IN STUDENT ATHLETES.
1414 (a) A school district may acquire for use in the district's
1515 interscholastic athletic program an electroencephalogram brain
1616 assessment platform designed to establish a person's baseline brain
1717 function for comparison to the person's brain function following a
1818 concussive impact.
1919 (b) A district that acquires the electroencephalogram brain
2020 assessment platform described by Subsection (a) shall use the
2121 device to monitor student athletic program participants who
2222 experience a concussive impact to determine whether the student
2323 requires medical attention and whether the student may safely
2424 resume participation in athletic activity.
2525 (c) A district must obtain written consent from the
2626 student's parent or guardian or other person with legal authority
2727 to make medical decisions for the student before the device
2828 described by Subsection (a) may be used on the student.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2015.
