99 relating to the effect on local regulation of state law for fire
1010 extinguisher service and installation; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 6001, Insurance Code, is
1313 amended by adding Section 6001.003 to read as follows:
1414 Sec. 6001.003. EFFECT ON LOCAL REGULATION. (a) This
1515 chapter and the rules adopted under this chapter have uniform force
1616 and effect throughout this state. A municipality or county may not
1717 adopt or enforce an ordinance, order, or rule inconsistent with
1818 this chapter or rules adopted under this chapter. An inconsistent
1919 ordinance, order, or rule is void and has no effect.
2020 (b) Notwithstanding Subsection (a), a municipality or
2121 county may by ordinance or order:
2222 (1) require the installation of a fixed fire
2323 extinguisher system or portable fire extinguisher in certain
2424 facilities if the installation conforms to the applicable laws of
2525 this state; and
2626 (2) adopt more stringent standards for a fixed fire
2727 extinguisher system or portable fire extinguisher or standards that
2828 create a safer condition than the standards established under this
2929 chapter and the rules adopted under this chapter.
3030 (c) A municipality, county, or other political subdivision
3131 of this state may not require, as a condition of engaging in
3232 business or performing any activity authorized under this chapter,
3333 that a registered firm, a license holder, or an employee of a
3434 license holder:
3535 (1) obtain a registration, franchise, or license;
3636 (2) pay any fee or franchise tax; or
3737 (3) post a bond.
3838 (d) Notwithstanding any other provision of this section or
3939 Section 6001.156, a municipality or county may by ordinance or
4040 order require a registered firm to obtain a permit and pay a permit
4141 fee for the installation of a fixed fire extinguisher system and
4242 require that the installation of such a fixed fire extinguisher
4343 system be in conformance with the building code or other
4444 construction requirements of the municipality or county and the
4545 laws of this state.
4646 (e) Notwithstanding Subsection (d), a municipality or
4747 county may not impose qualification or financial responsibility
4848 requirements other than proof of a registration certificate.
4949 (f) A political subdivision may not require a registered
5050 firm, a license holder, or an employee of a registered firm to
5151 maintain a business location or residency within that political
5252 subdivision to engage in a business or perform any activity
5353 authorized under this chapter.
5454 SECTION 2. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2015.
