11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 6001, Insurance Code, is |
---|
13 | 13 | | amended by adding Section 6001.003 to read as follows: |
---|
14 | 14 | | Sec. 6001.003. EFFECT ON LOCAL REGULATION. (a) This |
---|
15 | 15 | | chapter and the rules adopted under this chapter have uniform force |
---|
16 | 16 | | and effect throughout this state. A municipality or county may not |
---|
17 | 17 | | adopt or enforce an ordinance, order, or rule inconsistent with |
---|
18 | 18 | | this chapter or rules adopted under this chapter. An inconsistent |
---|
19 | 19 | | ordinance, order, or rule is void and has no effect. |
---|
20 | 20 | | (b) Notwithstanding Subsection (a), a municipality or |
---|
21 | 21 | | county may by ordinance or order: |
---|
22 | 22 | | (1) require the installation of a fixed fire |
---|
23 | 23 | | extinguisher system or portable fire extinguisher in certain |
---|
24 | 24 | | facilities if the installation conforms to the applicable laws of |
---|
25 | 25 | | this state; and |
---|
26 | 26 | | (2) adopt more stringent standards for a fixed fire |
---|
27 | 27 | | extinguisher system or portable fire extinguisher or standards that |
---|
28 | 28 | | create a safer condition than the standards established under this |
---|
29 | 29 | | chapter and the rules adopted under this chapter. |
---|
30 | 30 | | (c) A municipality, county, or other political subdivision |
---|
31 | 31 | | of this state may not require, as a condition of engaging in |
---|
32 | 32 | | business or performing any activity authorized under this chapter, |
---|
33 | 33 | | that a registered firm, a license holder, or an employee of a |
---|
34 | 34 | | license holder: |
---|
35 | 35 | | (1) obtain a registration, franchise, or license; |
---|
36 | 36 | | (2) pay any fee or franchise tax; or |
---|
37 | 37 | | (3) post a bond. |
---|
38 | 38 | | (d) Notwithstanding any other provision of this section or |
---|
39 | 39 | | Section 6001.156, a municipality or county may by ordinance or |
---|
40 | 40 | | order require a registered firm to obtain a permit and pay a permit |
---|
41 | 41 | | fee for the installation of a fixed fire extinguisher system and |
---|
42 | 42 | | require that the installation of such a fixed fire extinguisher |
---|
43 | 43 | | system be in conformance with the building code or other |
---|
44 | 44 | | construction requirements of the municipality or county and the |
---|
45 | 45 | | laws of this state. |
---|
46 | 46 | | (e) Notwithstanding Subsection (d), a municipality or |
---|
47 | 47 | | county may not impose qualification or financial responsibility |
---|
48 | 48 | | requirements other than proof of a registration certificate. |
---|
49 | 49 | | (f) A political subdivision may not require a registered |
---|
50 | 50 | | firm, a license holder, or an employee of a registered firm to |
---|
51 | 51 | | maintain a business location or residency within that political |
---|
52 | 52 | | subdivision to engage in a business or perform any activity |
---|
53 | 53 | | authorized under this chapter. |
---|
54 | 54 | | SECTION 2. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2015. |
