88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 64.01(a-1), Code of Criminal Procedure,
1010 is amended to read as follows:
1111 (a-1) A convicted person may submit to the convicting court
1212 a motion for forensic DNA testing of evidence that has a reasonable
1313 likelihood of containing biological material. The motion must be
1414 accompanied by an affidavit, sworn to by the convicted person,
1515 containing statements of fact in support of the motion.
1616 SECTION 2. Article 64.03, Code of Criminal Procedure, is
1717 amended by amending Subsection (a) and adding Subsection (a-1) to
1818 read as follows:
1919 (a) A convicting court may order forensic DNA testing under
2020 this chapter only if:
2121 (1) the court finds that:
2222 (A) the evidence:
2323 (i) still exists and is in a condition
2424 making DNA testing possible; and
2525 (ii) has been subjected to a chain of
2626 custody sufficient to establish that it has not been substituted,
2727 tampered with, replaced, or altered in any material respect; [and]
2828 (B) there is a reasonable likelihood that the
2929 evidence contains biological material suitable for DNA testing; and
3030 (C) identity was or is an issue in the case; and
3131 (2) the convicted person establishes by a
3232 preponderance of the evidence that:
3333 (A) the person would not have been convicted if
3434 exculpatory results had been obtained through DNA testing; and
3535 (B) the request for the proposed DNA testing is
3636 not made to unreasonably delay the execution of sentence or
3737 administration of justice.
3838 (a-1) In this article, the term "exculpatory results"
3939 includes DNA test results that indicate a match, pursuant to a
4040 comparison procedure such as that required under Article 64.035,
4141 between an unidentified DNA profile on the evidence tested and
4242 another individual's DNA profile contained in a DNA database
4343 described by that article.
4444 SECTION 3. The change in law made by this Act applies to a
4545 motion for forensic DNA testing filed on or after the effective date
4646 of this Act. A motion for forensic DNA testing filed before the
4747 effective date of this Act is governed by the law in effect on the
4848 date the motion was filed, and the former law is continued in effect
4949 for that purpose.
5050 SECTION 4. This Act takes effect September 1, 2015.
