55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the lunch period for classroom teachers at the middle
88 school, junior high school, or high school grade level.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.405(a), Education Code, is amended to
1111 read as follows:
1212 (a) Except as provided by Subsection (c), each classroom
1313 teacher or full-time librarian at the elementary school level is
1414 entitled to at least a 30-minute lunch period free from all duties
1515 and responsibilities connected with the instruction and
1616 supervision of students. Except as provided by Subsection (c),
1717 each classroom teacher or full-time librarian at the middle school,
1818 junior high school, or high school grade level is entitled to at
1919 least a 45-minute lunch period free from all duties and
2020 responsibilities connected with the instruction and supervision of
2121 students. Each school district may set flexible or rotating
2222 schedules for each classroom teacher or full-time librarian in the
2323 district for the implementation of the duty-free lunch period.
2424 SECTION 2. This Act applies beginning with the 2015-2016
2525 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2015.
