9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 21.405(a), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (a) Except as provided by Subsection (c), each classroom |
---|
13 | 13 | | teacher or full-time librarian at the elementary school level is |
---|
14 | 14 | | entitled to at least a 30-minute lunch period free from all duties |
---|
15 | 15 | | and responsibilities connected with the instruction and |
---|
16 | 16 | | supervision of students. Except as provided by Subsection (c), |
---|
17 | 17 | | each classroom teacher or full-time librarian at the middle school, |
---|
18 | 18 | | junior high school, or high school grade level is entitled to at |
---|
19 | 19 | | least a 45-minute lunch period free from all duties and |
---|
20 | 20 | | responsibilities connected with the instruction and supervision of |
---|
21 | 21 | | students. Each school district may set flexible or rotating |
---|
22 | 22 | | schedules for each classroom teacher or full-time librarian in the |
---|
23 | 23 | | district for the implementation of the duty-free lunch period. |
---|
24 | 24 | | SECTION 2. This Act applies beginning with the 2015-2016 |
---|
25 | 25 | | school year. |
---|
26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2015. |
