55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to conduct that constitutes the offense of displaying a
88 firearm in a public place.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 42.01(a), (d), and (e), Penal Code, are
1111 amended to read as follows:
1212 (a) A person commits an offense if he intentionally or
1313 knowingly:
1414 (1) uses abusive, indecent, profane, or vulgar
1515 language in a public place, and the language by its very utterance
1616 tends to incite an immediate breach of the peace;
1717 (2) makes an offensive gesture or display in a public
1818 place, and the gesture or display tends to incite an immediate
1919 breach of the peace;
2020 (3) creates, by chemical means, a noxious and
2121 unreasonable odor in a public place;
2222 (4) abuses or threatens a person in a public place in
2323 an obviously offensive manner;
2424 (5) makes unreasonable noise in a public place other
2525 than a sport shooting range, as defined by Section 250.001, Local
2626 Government Code, or in or near a private residence that he has no
2727 right to occupy;
2828 (6) fights with another in a public place;
2929 (7) discharges a firearm in a public place other than a
3030 public road or a sport shooting range, as defined by Section
3131 250.001, Local Government Code;
3232 (8) [displays a firearm or other deadly weapon in a
3333 public place in a manner calculated to alarm;
3434 [(9)] discharges a firearm on or across a public road;
3535 (9) [(10)] exposes his anus or genitals in a public
3636 place and is reckless about whether another may be present who will
3737 be offended or alarmed by his act; or
3838 (10) [(11)] for a lewd or unlawful purpose:
3939 (A) enters on the property of another and looks
4040 into a dwelling on the property through any window or other opening
4141 in the dwelling;
4242 (B) while on the premises of a hotel or
4343 comparable establishment, looks into a guest room not the person's
4444 own through a window or other opening in the room; or
4545 (C) while on the premises of a public place,
4646 looks into an area such as a restroom or shower stall or changing or
4747 dressing room that is designed to provide privacy to a person using
4848 the area.
4949 (d) An offense under this section is a Class C misdemeanor
5050 unless committed under Subsection (a)(7) [or (a)(8)], in which
5151 event it is a Class B misdemeanor.
5252 (e) It is a defense to prosecution for an offense under
5353 Subsection (a)(7) or (8) [(9)] that the person who discharged the
5454 firearm had a reasonable fear of bodily injury to the person or to
5555 another by a dangerous wild animal as defined by Section 822.101,
5656 Health and Safety Code.
5757 SECTION 2. Section 250.006(b), Health and Safety Code, is
5858 amended to read as follows:
5959 (b) A person may not be employed in a position the duties of
6060 which involve direct contact with a consumer in a facility or may
6161 not be employed by an individual employer before the fifth
6262 anniversary of the date the person is convicted of:
6363 (1) an offense under Section 22.01, Penal Code
6464 (assault), that is punishable as a Class A misdemeanor or as a
6565 felony;
6666 (2) an offense under Section 30.02, Penal Code
6767 (burglary);
6868 (3) an offense under Chapter 31, Penal Code (theft),
6969 that is punishable as a felony;
7070 (4) an offense under Section 32.45, Penal Code
7171 (misapplication of fiduciary property or property of a financial
7272 institution), that is punishable as a Class A misdemeanor or a
7373 felony;
7474 (5) an offense under Section 32.46, Penal Code
7575 (securing execution of a document by deception), that is punishable
7676 as a Class A misdemeanor or a felony;
7777 (6) an offense under Section 37.12, Penal Code (false
7878 identification as peace officer); or
7979 (7) an offense under Section 42.01(a)(7)[,] or (8),
8080 [or (9),] Penal Code (disorderly conduct).
8181 SECTION 3. (a) The change in law made by this Act to
8282 Section 42.01, Penal Code, applies only to an offense committed on
8383 or after the effective date of this Act. An offense committed before
8484 the effective date of this Act is governed by the law in effect on
8585 the date the offense was committed, and the former law is continued
8686 in effect for that purpose. For purposes of this section, an offense
8787 was committed before the effective date of this Act if any element
8888 of the offense occurred before that date.
8989 (b) The change in law made by this Act to Section 250.006,
9090 Health and Safety Code, applies to the employability of a nurse aide
9191 based on criminal history record information for that person
9292 relating to a conviction or placement on deferred adjudication
9393 community supervision for an offense under Section 42.01, Penal
9494 Code, committed on or after the effective date of this Act. The
9595 employability of a nurse aide based on criminal history record
9696 information for that person relating to a conviction or placement
9797 on deferred adjudication community supervision for an offense under
9898 Section 42.01, Penal Code, that was committed before the effective
9999 date of this Act is governed by the law in effect on the date the
100100 offense was committed, and the former law is continued in effect for
101101 that purpose. For purposes of this section, an offense was
102102 committed before the effective date of this Act if any element of
103103 the offense occurred before that date.
104104 SECTION 4. This Act takes effect September 1, 2015.
