55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of an advisory committee to examine the
88 state jail system within the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Department" means the Texas Department of
1212 Criminal Justice.
1313 (2) "State jail" means a state jail felony facility
1414 operated by or under contract with the department under Section
1515 507.001, Government Code.
1616 SECTION 2. VOLUNTARY STATE JAIL ADVISORY COMMITTEE. Not
1717 later than December 1, 2015, the department shall convene an
1818 advisory committee composed of volunteers to review the problems
1919 facing the state jail system and provide recommendations to guide
2020 state criminal justice policies and practices relating to state
2121 jails.
2222 SECTION 3. MEMBERS; PRESIDING OFFICER. (a) In recruiting
2323 volunteers to serve on the advisory committee, the department shall
2424 include members who are interested parties, including:
2525 (1) representatives of the department;
2626 (2) representatives of community supervision and
2727 corrections departments established under Chapter 76, Government
2828 Code;
2929 (3) district or county attorneys in this state;
3030 (4) criminal defense attorneys;
3131 (5) individuals who have expertise in the state jail
3232 system and are members of an advocacy or civil rights organization;
3333 (6) individuals who have expertise in issues related
3434 to criminal justice and criminal law;
3535 (7) individuals who have expertise in issues related
3636 to substance abuse and mental health;
3737 (8) individuals who were formerly incarcerated in the
3838 state jail system; and
3939 (9) any other individuals or organizations who may be
4040 helpful in addressing the problems facing the state jail system.
4141 (b) The advisory committee shall designate one of the
4242 members as presiding officer of the committee.
4343 SECTION 4. REPORT. (a) Not later than August 1, 2016, the
4444 advisory committee shall submit to the department, including the
4545 community justice assistance division of the department, the
4646 governor, the lieutenant governor, the speaker of the house of
4747 representatives, and the standing committees in the senate and
4848 house of representatives primarily responsible for criminal
4949 justice issues a report containing the recommendations developed
5050 under Section 2 of this Act.
5151 (b) The department shall make the report submitted under
5252 Subsection (a) of this section available to the public and shall
5353 publish the report on its Internet website.
5454 SECTION 5. COMPENSATION. Members of the advisory committee
5555 serve without compensation and are not entitled to reimbursement
5656 for expenses.
5757 SECTION 6. APPLICATION OF LAWS GOVERNING ADVISORY
5858 COMMITTEES. The advisory committee is not subject to Chapter 2110,
5959 Government Code.
6060 SECTION 7. EXPIRATION DATE. The advisory committee is
6161 abolished and this Act expires January 1, 2017.
6262 SECTION 8. EFFECTIVE DATE. This Act takes effect
6363 immediately if it receives a vote of two-thirds of all the members
6464 elected to each house, as provided by Section 39, Article III, Texas
6565 Constitution. If this Act does not receive the vote necessary for
6666 immediate effect, this Act takes effect September 1, 2015.
