54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to the transfer of certain state real property from the
87 Texas Department of Transportation to the City of Laredo.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. (a) Subject to Section 2 of this Act, the Texas
1110 Department of Transportation shall transfer by appropriate
1211 instrument of transfer to the City of Laredo the real property
1312 described by Section 3 of this Act.
1413 (b) Before the transfer of a parcel of real property
1514 described by Section 3 of this Act is made, a survey of the parcel
1615 may be conducted by or under the direction of the General Land
1716 Office.
1817 (c) The City of Laredo must use the real property described
1918 by Section 3 of this Act to primarily promote a public purpose of
2019 the state by enhancing tourism and providing recreation and civic
2120 improvement.
2221 SECTION 2. (a) Ownership of the property automatically
2322 reverts to the State of Texas:
2423 (1) on request of the Texas Department of
2524 Transportation; or
2625 (2) if the City of Laredo:
2726 (A) fails to promote a public purpose of the
2827 state as described by Section 1(c) of this Act; or
2928 (B) sells all or any part of the property.
3029 (b) The state reserves:
3130 (1) the state's interest in all oil, gas, and other
3231 minerals in and under the real property described by Section 3 of
3332 this Act;
3433 (2) the state's right to remove from the real property
3534 described by Section 3 of this Act any oil, gas, and other minerals
3635 in and under the real property; and
3736 (3) the state's right to grant a lease held by the
3837 state before a conveyance of real property described by Section 3 of
3938 this Act relating to the removal of oil, gas, and other minerals in
4039 and under the real property.
4140 (c) Sections 31.1571 and 31.158, Natural Resources Code, do
4241 not apply to the transfer of real property authorized by this Act.
4342 SECTION 3. The real property held by the Texas Department of
4443 Transportation, which are remainder properties from the expansion
4544 and extension of Interstate Highway 35, which said four remnant
4645 tracts within the corporate limits of the City of Laredo and bounded
4746 on the north by Victoria Street; bounded on the east by Santa Ursula
4847 Avenue; bounded on the south by Hidalgo Street; and bounded on the
4948 west by San Dario Avenue, and are more particularly described as
5049 follows:
5150 Tract 1 (North most tract) bounded on north by Victoria Street; on
5251 the east by Santa Ursula Avenue; bounded on the south by Houston
5352 Street and bounded on the west by San Dario Avenue.
5453 Tract 2 bounded on the north by Houston Street; on the east by Santa
5554 Ursula Avenue; on the south by Matamoros Street and on the west by
5655 San Dario Avenue.
5756 Tract 3 bounded on the north by Matamoros Street, on the east by
5857 Santa Ursula Avenue; on the south by Farragut Street and on the west
5958 by San Dario Avenue.
6059 Tract 4 (Southernmost tract) bounded on the north by Matamoros
6160 Street, on the east by Santa Ursula Avenue on the south by Hidalgo
6261 Street and on the west by San Dario Avenue.
6362 SECTION 4. This Act takes effect immediately if it receives
6463 a vote of two-thirds of all the members elected to each house, as
6564 provided by Section 39, Article III, Texas Constitution. If this
6665 Act does not receive the vote necessary for immediate effect, this
6766 Act takes effect September 1, 2015.
