7 | 6 | | relating to the transfer of certain state real property from the |
---|
8 | 7 | | Texas Department of Transportation to the City of Laredo. |
---|
9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 9 | | SECTION 1. (a) Subject to Section 2 of this Act, the Texas |
---|
11 | 10 | | Department of Transportation shall transfer by appropriate |
---|
12 | 11 | | instrument of transfer to the City of Laredo the real property |
---|
13 | 12 | | described by Section 3 of this Act. |
---|
14 | 13 | | (b) Before the transfer of a parcel of real property |
---|
15 | 14 | | described by Section 3 of this Act is made, a survey of the parcel |
---|
16 | 15 | | may be conducted by or under the direction of the General Land |
---|
17 | 16 | | Office. |
---|
18 | 17 | | (c) The City of Laredo must use the real property described |
---|
19 | 18 | | by Section 3 of this Act to primarily promote a public purpose of |
---|
20 | 19 | | the state by enhancing tourism and providing recreation and civic |
---|
21 | 20 | | improvement. |
---|
22 | 21 | | SECTION 2. (a) Ownership of the property automatically |
---|
23 | 22 | | reverts to the State of Texas: |
---|
24 | 23 | | (1) on request of the Texas Department of |
---|
25 | 24 | | Transportation; or |
---|
26 | 25 | | (2) if the City of Laredo: |
---|
27 | 26 | | (A) fails to promote a public purpose of the |
---|
28 | 27 | | state as described by Section 1(c) of this Act; or |
---|
29 | 28 | | (B) sells all or any part of the property. |
---|
30 | 29 | | (b) The state reserves: |
---|
31 | 30 | | (1) the state's interest in all oil, gas, and other |
---|
32 | 31 | | minerals in and under the real property described by Section 3 of |
---|
33 | 32 | | this Act; |
---|
34 | 33 | | (2) the state's right to remove from the real property |
---|
35 | 34 | | described by Section 3 of this Act any oil, gas, and other minerals |
---|
36 | 35 | | in and under the real property; and |
---|
37 | 36 | | (3) the state's right to grant a lease held by the |
---|
38 | 37 | | state before a conveyance of real property described by Section 3 of |
---|
39 | 38 | | this Act relating to the removal of oil, gas, and other minerals in |
---|
40 | 39 | | and under the real property. |
---|
41 | 40 | | (c) Sections 31.1571 and 31.158, Natural Resources Code, do |
---|
42 | 41 | | not apply to the transfer of real property authorized by this Act. |
---|
43 | 42 | | SECTION 3. The real property held by the Texas Department of |
---|
44 | 43 | | Transportation, which are remainder properties from the expansion |
---|
45 | 44 | | and extension of Interstate Highway 35, which said four remnant |
---|
46 | 45 | | tracts within the corporate limits of the City of Laredo and bounded |
---|
47 | 46 | | on the north by Victoria Street; bounded on the east by Santa Ursula |
---|
48 | 47 | | Avenue; bounded on the south by Hidalgo Street; and bounded on the |
---|
49 | 48 | | west by San Dario Avenue, and are more particularly described as |
---|
50 | 49 | | follows: |
---|
51 | 50 | | Tract 1 (North most tract) bounded on north by Victoria Street; on |
---|
52 | 51 | | the east by Santa Ursula Avenue; bounded on the south by Houston |
---|
53 | 52 | | Street and bounded on the west by San Dario Avenue. |
---|
54 | 53 | | Tract 2 bounded on the north by Houston Street; on the east by Santa |
---|
55 | 54 | | Ursula Avenue; on the south by Matamoros Street and on the west by |
---|
56 | 55 | | San Dario Avenue. |
---|
57 | 56 | | Tract 3 bounded on the north by Matamoros Street, on the east by |
---|
58 | 57 | | Santa Ursula Avenue; on the south by Farragut Street and on the west |
---|
59 | 58 | | by San Dario Avenue. |
---|
60 | 59 | | Tract 4 (Southernmost tract) bounded on the north by Matamoros |
---|
61 | 60 | | Street, on the east by Santa Ursula Avenue on the south by Hidalgo |
---|
62 | 61 | | Street and on the west by San Dario Avenue. |

63 | 62 | | SECTION 4. This Act takes effect immediately if it receives |
---|
64 | 63 | | a vote of two-thirds of all the members elected to each house, as |
---|
65 | 64 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
66 | 65 | | Act does not receive the vote necessary for immediate effect, this |
---|
67 | 66 | | Act takes effect September 1, 2015. |
---|
