| 8 | 8 | | Public Safety from an applicant for a driver's license or personal |
|---|
| 9 | 9 | | identification certificate and used for the department's image |
|---|
| 10 | 10 | | verification system. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Sections 521.059(a) and (b), Transportation |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (a) The department shall establish an image verification |
|---|
| 15 | 15 | | system based on the following identifiers collected by the |
|---|
| 16 | 16 | | department under Section 521.142(b): |
|---|
| 17 | 17 | | (1) an applicant's facial image; and |
|---|
| 18 | 18 | | (2) an applicant's thumbprints and [or] fingerprints. |
|---|
| 19 | 19 | | (b) The department shall authenticate the facial image, |
|---|
| 20 | 20 | | [and] thumbprints, and [or] fingerprints provided by an applicant |
|---|
| 21 | 21 | | for a personal identification certificate, driver's license, or |
|---|
| 22 | 22 | | commercial driver's license or permit using image comparison |
|---|
| 23 | 23 | | technology to ensure that the applicant: |
|---|
| 24 | 24 | | (1) is issued only one original license, permit, or |
|---|
| 25 | 25 | | certificate; |
|---|
| 26 | 26 | | (2) does not fraudulently obtain a duplicate license, |
|---|
| 27 | 27 | | permit, or certificate; and |
|---|
| 28 | 28 | | (3) does not commit other fraud in connection with the |
|---|
| 29 | 29 | | application for a license, permit, or certificate. |
|---|
| 30 | 30 | | SECTION 2. Section 521.142(b), Transportation Code, is |
|---|
| 31 | 31 | | amended to read as follows: |
|---|
| 32 | 32 | | (b) The application must include: |
|---|
| 33 | 33 | | (1) the thumbprints and [of the applicant or, if |
|---|
| 34 | 34 | | thumbprints cannot be taken, the index] fingerprints of the |
|---|
| 35 | 35 | | applicant; |
|---|
| 36 | 36 | | (2) a photograph of the applicant; |
|---|
| 37 | 37 | | (3) the signature of the applicant; and |
|---|
| 38 | 38 | | (4) a brief description of the applicant. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2015. |
