| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 43.363(a), Parks and Wildlife Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) A person in this state may sell, transfer, ship, or | |
| 13 | 13 | transport a breeder deer only during the period March 1 through June | |
| 14 | 14 | 1 of any year, [During an open hunting season for deer or during the | |
| 15 | 15 | 10-day period immediately preceding an open hunting season, no | |
| 16 | 16 | person in this state may sell, transfer, ship, or transport a | |
| 17 | 17 | breeder deer] unless the person: | |
| 18 | 18 | (1) has removed the antlers of the breeder deer | |
| 19 | 19 | between the G-3 tine, as defined by the Boone and Crockett Club, and | |
| 20 | 20 | the pedicel on each antler main beam; and | |
| 21 | 21 | (2) has followed any procedure prescribed by rule of | |
| 22 | 22 | the commission for the lawful conduct of activities under this | |
| 23 | 23 | subchapter. | |
| 24 | 24 | SECTION 2. This Act takes effect January 1, 2017. |
