66 AN ACT
77 relating to requirements for the issuance of a driver's license or
88 personal identification certificate.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.044(a), Transportation Code, as
1111 amended by Chapters 1012 (H.B. 2512) and 1105 (H.B. 3787), Acts of
1212 the 83rd Legislature, Regular Session, 2013, is reenacted and
1313 amended to read as follows:
1414 (a) Information provided on a driver's license or personal
1515 identification certificate application that relates to the
1616 applicant's social security number may be used only by the
1717 department or disclosed only to:
1818 (1) the child support enforcement division of the
1919 attorney general's office;
2020 (2) another state entity responsible for enforcing the
2121 payment of child support;
2222 (3) the United States Selective Service System as
2323 provided by Section 521.147;
2424 (4) the unclaimed property division of the
2525 comptroller's office; [or]
2626 (5) the Health and Human Services Commission;
2727 (6) [(5)] the secretary of state for the purposes of
2828 voter registration or the administration of elections; or
2929 (7) an agency of another state responsible for issuing
3030 driver's licenses or identification documents.
3131 SECTION 2. Sections 521.044(b) and (e), Transportation
3232 Code, are amended to read as follows:
3333 (b) The department shall enter an applicant's social
3434 security number in the department's electronic database but may not
3535 print the number on the applicant's driver's license or personal
3636 identification certificate.
3737 (e) The department shall include in the department's
3838 legislative appropriations requests and budgets, in quarterly
3939 performance reports, and in audits of the department's local
4040 offices performance measures on the percentage of complete and
4141 correct social security numbers on driver's licenses and personal
4242 identification certificates.
4343 SECTION 3. Section 521.101(f), Transportation Code, is
4444 amended to read as follows:
4545 (f) A personal identification certificate:
4646 (1) for an applicant who is a citizen, national, or
4747 legal permanent resident of the United States or a refugee or asylee
4848 lawfully admitted into the United States, [:
4949 [(A)] expires on a date specified by the
5050 department [if the applicant is younger than 60 years of age; or
5151 [(B) does not expire if the applicant is 60 years
5252 of age or older]; or
5353 (2) for an applicant not described by Subdivision (1),
5454 expires on:
5555 (A) the earlier of:
5656 (i) a date specified by the department; or
5757 (ii) the expiration date of the applicant's
5858 authorized stay in the United States; or
5959 (B) the first anniversary of the date of
6060 issuance, if there is no definite expiration date for the
6161 applicant's authorized stay in the United States.
6262 SECTION 4. Section 521.142(g), Transportation Code, is
6363 amended to read as follows:
6464 (g) The department shall [may] require an applicant to
6565 provide the applicant's social security number or proof that the
6666 applicant is not eligible for a social security number [only for a
6767 purpose permitted by Section 521.044].
6868 SECTION 5. Subchapter I, Chapter 521, Transportation Code,
6969 is amended by adding Section 521.183 to read as follows:
7070 Sec. 521.183. SURRENDER OF DRIVER'S LICENSE OR PERSONAL
7171 IDENTIFICATION CERTIFICATE. (a) A person is not entitled to
7272 receive a driver's license until the person surrenders to the
7373 department each personal identification certificate in the
7474 person's possession that was issued by this state.
7575 (b) A person is not entitled to receive a personal
7676 identification certificate until the person surrenders to the
7777 department each driver's license in the person's possession that
7878 was issued by this state.
7979 SECTION 6. The changes in law made by this Act apply only to
8080 a driver's license or personal identification certificate for which
8181 an application is submitted on or after the effective date of this
8282 Act. A driver's license or personal identification certificate for
8383 which an application was submitted before the effective date of
8484 this Act is governed by the law as it existed immediately before the
8585 effective date of this Act, and that law is continued in effect for
8686 that purpose.
8787 SECTION 7. To the extent of any conflict, this Act prevails
8888 over another Act of the 84th Legislature, Regular Session, 2015,
8989 relating to nonsubstantive additions to and corrections in enacted
9090 codes.
9191 SECTION 8. This Act takes effect September 1, 2015.
