6	6	AN ACT
7	7	relating to requirements for the issuance of a driver's license or
8	8	personal identification certificate.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 521.044(a), Transportation Code, as
11	11	amended by Chapters 1012 (H.B. 2512) and 1105 (H.B. 3787), Acts of
12	12	the 83rd Legislature, Regular Session, 2013, is reenacted and
13	13	amended to read as follows:
14	14	(a) Information provided on a driver's license or personal
15	15	identification certificate application that relates to the
16	16	applicant's social security number may be used only by the
17	17	department or disclosed only to:
18	18	(1) the child support enforcement division of the
19	19	attorney general's office;
20	20	(2) another state entity responsible for enforcing the
21	21	payment of child support;
22	22	(3) the United States Selective Service System as
23	23	provided by Section 521.147;
24	24	(4) the unclaimed property division of the
25	25	comptroller's office; [or]
26	26	(5) the Health and Human Services Commission;
27	27	(6) [(5)] the secretary of state for the purposes of
28	28	voter registration or the administration of elections; or
29	29	(7) an agency of another state responsible for issuing
30	30	driver's licenses or identification documents.
31	31	SECTION 2. Sections 521.044(b) and (e), Transportation
32	32	Code, are amended to read as follows:
33	33	(b) The department shall enter an applicant's social
34	34	security number in the department's electronic database but may not
35	35	print the number on the applicant's driver's license or personal
36	36	identification certificate.
37	37	(e) The department shall include in the department's
38	38	legislative appropriations requests and budgets, in quarterly
39	39	performance reports, and in audits of the department's local
40	40	offices performance measures on the percentage of complete and
41	41	correct social security numbers on driver's licenses and personal
42	42	identification certificates.
43	43	SECTION 3. Section 521.101(f), Transportation Code, is
44	44	amended to read as follows:
45	45	(f) A personal identification certificate:
46	46	(1) for an applicant who is a citizen, national, or
47	47	legal permanent resident of the United States or a refugee or asylee
48	48	lawfully admitted into the United States, [:
49	49	[(A)] expires on a date specified by the
50	50	department [if the applicant is younger than 60 years of age; or
51	51	[(B) does not expire if the applicant is 60 years
52	52	of age or older]; or
53	53	(2) for an applicant not described by Subdivision (1),
54	54	expires on:
55	55	(A) the earlier of:
56	56	(i) a date specified by the department; or
57	57	(ii) the expiration date of the applicant's
58	58	authorized stay in the United States; or
59	59	(B) the first anniversary of the date of
60	60	issuance, if there is no definite expiration date for the
61	61	applicant's authorized stay in the United States.
62	62	SECTION 4. Section 521.142(g), Transportation Code, is
63	63	amended to read as follows:
64	64	(g) The department shall [may] require an applicant to
65	65	provide the applicant's social security number or proof that the
66	66	applicant is not eligible for a social security number [only for a
67	67	purpose permitted by Section 521.044].
68	68	SECTION 5. Subchapter I, Chapter 521, Transportation Code,
69	69	is amended by adding Section 521.183 to read as follows:
70	70	Sec. 521.183. SURRENDER OF DRIVER'S LICENSE OR PERSONAL
71	71	IDENTIFICATION CERTIFICATE. (a) A person is not entitled to
72	72	receive a driver's license until the person surrenders to the
73	73	department each personal identification certificate in the
74	74	person's possession that was issued by this state.
75	75	(b) A person is not entitled to receive a personal
76	76	identification certificate until the person surrenders to the
77	77	department each driver's license in the person's possession that
78	78	was issued by this state.
79	79	SECTION 6. The changes in law made by this Act apply only to
80	80	a driver's license or personal identification certificate for which
81	81	an application is submitted on or after the effective date of this
82	82	Act. A driver's license or personal identification certificate for
83	83	which an application was submitted before the effective date of
84	84	this Act is governed by the law as it existed immediately before the
85	85	effective date of this Act, and that law is continued in effect for
86	86	that purpose.
87	87	SECTION 7. To the extent of any conflict, this Act prevails
88	88	over another Act of the 84th Legislature, Regular Session, 2015,
89	89	relating to nonsubstantive additions to and corrections in enacted
90	90	codes.
91	91	SECTION 8. This Act takes effect September 1, 2015.
