55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the validity, reliability, and design of certain
88 state-adopted or state-developed assessment instruments for public
99 school students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.023, Education Code, is amended by
1212 adding Subsections (a-11) and (a-12) to read as follows:
1313 (a-11) Subject to available appropriations, before an
1414 assessment instrument adopted or developed under Subsection (a) may
1515 be administered under that subsection, the assessment instrument
1616 must, on the basis of empirical evidence, be determined to be valid
1717 and reliable by a research institution that:
1818 (1) has nationally recognized expertise in
1919 determining validity and reliability of assessment instruments;
2020 and
2121 (2) is independent of the agency and of any other
2222 entity that developed the assessment instrument.
2323 (a-12) The agency shall ensure that an assessment
2424 instrument adopted or developed under Subsection (a) is designed
2525 only to assess student understanding of the essential knowledge and
2626 skills identified by the State Board of Education under Section
2727 28.002 of the subject and for the grade level for which the
2828 assessment instrument is administered.
2929 SECTION 2. This Act applies beginning with the 2015-2016
3030 school year.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2015.
