| 7 | 7 | | relating to the issuance of occupational licenses to certain |

| 8 | 8 | | out-of-state applicants. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Title 2, Occupations Code, is amended by adding |
|---|
| 11 | 11 | | Chapter 60 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 60. LICENSING OUT-OF-STATE APPLICANTS |
|---|
| 13 | 13 | | Sec. 60.001. DEFINITIONS. In this chapter: |
|---|
| 14 | 14 | | (1) "License" means a license, certificate, |
|---|
| 15 | 15 | | registration, permit, or other form of authorization required by |
|---|
| 16 | 16 | | law or a state agency rule that must be obtained by an individual to |
|---|
| 17 | 17 | | engage in a particular occupation. |
|---|
| 18 | 18 | | (2) "State agency" means a department, board, bureau, |
|---|
| 19 | 19 | | commission, committee, division, office, council, or agency of the |
|---|
| 20 | 20 | | state. |
|---|
| 21 | 21 | | Sec. 60.002. LICENSING OF OUT-OF-STATE APPLICANTS. |
|---|
| 22 | 22 | | Notwithstanding any other law, a state agency that issues a license |
|---|
| 23 | 23 | | shall waive all education, training, experience, and examination |
|---|
| 24 | 24 | | requirements for obtaining a license for an applicant for the |
|---|
| 25 | 25 | | license after reviewing the applicant's credentials and |
|---|
| 26 | 26 | | determining that: |
|---|
| 27 | 27 | | (1) the applicant holds a license issued by another |
|---|
| 28 | 28 | | state for an occupation that is substantially equivalent to the |
|---|
| 29 | 29 | | occupation for which the agency issues the license; and |
|---|
| 30 | 30 | | (2) the license granted to the applicant by the other |
|---|
| 31 | 31 | | state has not been restricted, suspended, revoked, or surrendered |
|---|
| 32 | 32 | | for any reason. |
|---|
| 33 | 33 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 34 | 34 | | to an application for a license submitted to a state agency on or |
|---|
| 35 | 35 | | after the effective date of this Act. An application submitted to a |
|---|
| 36 | 36 | | state agency before the effective date of this Act is governed by |
|---|
| 37 | 37 | | the law in effect on the date the application was submitted, and the |
|---|
| 38 | 38 | | former law is continued in effect for that purpose. |

| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2015. |
