55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the issuance of occupational licenses to certain
88 out-of-state applicants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 2, Occupations Code, is amended by adding
1111 Chapter 60 to read as follows:
1212 CHAPTER 60. LICENSING OUT-OF-STATE APPLICANTS
1313 Sec. 60.001. DEFINITIONS. In this chapter:
1414 (1) "License" means a license, certificate,
1515 registration, permit, or other form of authorization required by
1616 law or a state agency rule that must be obtained by an individual to
1717 engage in a particular occupation.
1818 (2) "State agency" means a department, board, bureau,
1919 commission, committee, division, office, council, or agency of the
2020 state.
2121 Sec. 60.002. LICENSING OF OUT-OF-STATE APPLICANTS.
2222 Notwithstanding any other law, a state agency that issues a license
2323 shall waive all education, training, experience, and examination
2424 requirements for obtaining a license for an applicant for the
2525 license after reviewing the applicant's credentials and
2626 determining that:
2727 (1) the applicant holds a license issued by another
2828 state for an occupation that is substantially equivalent to the
2929 occupation for which the agency issues the license; and
3030 (2) the license granted to the applicant by the other
3131 state has not been restricted, suspended, revoked, or surrendered
3232 for any reason.
3333 SECTION 2. The change in law made by this Act applies only
3434 to an application for a license submitted to a state agency on or
3535 after the effective date of this Act. An application submitted to a
3636 state agency before the effective date of this Act is governed by
3737 the law in effect on the date the application was submitted, and the
3838 former law is continued in effect for that purpose.
3939 SECTION 3. This Act takes effect September 1, 2015.
