| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 1601.353, Occupations Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | Sec. 1601.353. REQUIRED FACILITIES AND EQUIPMENT. The |
|---|
| 11 | 11 | | department may approve an application for a permit for a barber |
|---|
| 12 | 12 | | school if the school meets health and safety standards established |
|---|
| 13 | 13 | | by the department. The department shall not establish requirements |
|---|
| 14 | 14 | | for square footage of floor space, a specific number of chairs, a |
|---|
| 15 | 15 | | specific number of sinks, or other facility requirements not |
|---|
| 16 | 16 | | related to health and safety.: |
|---|
| 17 | 17 | | (1) is located in: |
|---|
| 18 | 18 | | (A) a municipality with a population of more than |
|---|
| 19 | 19 | | 50,000 that has a building of permanent construction containing at |
|---|
| 20 | 20 | | least 2,000 square feet of floor space, including classroom and |
|---|
| 21 | 21 | | practical areas, covered in a hard-surface floor-covering of tile |
|---|
| 22 | 22 | | or other suitable material; or |
|---|
| 23 | 23 | | (B) a municipality with a population of 50,000 or |
|---|
| 24 | 24 | | less or an unincorporated area of a county that has a building of |
|---|
| 25 | 25 | | permanent construction containing at least 1,000 square feet of |
|---|
| 26 | 26 | | floor space, including classroom and practical areas, covered in a |
|---|
| 27 | 27 | | hard-surface floor-covering of tile or other suitable material; |
|---|
| 28 | 28 | | (2) has the following equipment: |
|---|
| 29 | 29 | | (A) at least 10 student workstations that include |
|---|
| 30 | 30 | | a chair that reclines, a back bar, and a wall mirror; |
|---|
| 31 | 31 | | (B) a sink behind every two workstations; |
|---|
| 32 | 32 | | (C) adequate lighting for each room; |
|---|
| 33 | 33 | | (D) at least 10 classroom chairs and other |
|---|
| 34 | 34 | | materials necessary to teach the required subjects; and |
|---|
| 35 | 35 | | (E) access to permanent restrooms and adequate |
|---|
| 36 | 36 | | drinking fountain facilities; and |
|---|
| 37 | 37 | | (3) meets any other requirement set by the commission. |

| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2015. |
