55 AN ACT
66 relating to required facilities and equipment for barber schools.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1601.353, Occupations Code, is amended
99 to read as follows:
1010 Sec. 1601.353. REQUIRED FACILITIES AND EQUIPMENT. The
1111 department may approve an application for a permit for a barber
1212 school if the school meets health and safety standards established
1313 by the department. The department shall not establish requirements
1414 for square footage of floor space, a specific number of chairs, a
1515 specific number of sinks, or other facility requirements not
1616 related to health and safety.:
1717 (1) is located in:
1818 (A) a municipality with a population of more than
1919 50,000 that has a building of permanent construction containing at
2020 least 2,000 square feet of floor space, including classroom and
2121 practical areas, covered in a hard-surface floor-covering of tile
2222 or other suitable material; or
2323 (B) a municipality with a population of 50,000 or
2424 less or an unincorporated area of a county that has a building of
2525 permanent construction containing at least 1,000 square feet of
2626 floor space, including classroom and practical areas, covered in a
2727 hard-surface floor-covering of tile or other suitable material;
2828 (2) has the following equipment:
2929 (A) at least 10 student workstations that include
3030 a chair that reclines, a back bar, and a wall mirror;
3131 (B) a sink behind every two workstations;
3232 (C) adequate lighting for each room;
3333 (D) at least 10 classroom chairs and other
3434 materials necessary to teach the required subjects; and
3535 (E) access to permanent restrooms and adequate
3636 drinking fountain facilities; and
3737 (3) meets any other requirement set by the commission.
3838 SECTION 2. This Act takes effect September 1, 2015.
