20	5		relating to expenditures made by emergency services districts and
21	6		the sale of district property.
22	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
23	8		SECTION 1. Sections 775.073(a) and (d), Health and Safety
24	9		Code, are amended to read as follows:
25	10		(a) Except as otherwise provided by this section, district
26	11		funds may be disbursed only by check, draft, order, or other
27	12		instrument that:
28	13		(1) is signed by at least a majority of the board's
29	14		commissioners; or
30	15		(2) is signed by the treasurer, or by the assistant
31	16		treasurer if the treasurer is absent or unavailable, and
32	17		countersigned by the president, or by the vice president if the
33	18		president is absent or unavailable.
34	19		(d) Any property, including an interest in property,
35	20		purchased or leased using district funds, wholly or partly, must
36	21		remain the property of the district, regardless of whether the
37	22		property is used by a third party under a contract for services or
38	23		otherwise, until the property is disposed of in accordance with
39	24		Section 775.0735[:
40	25		[(1) the property is sold to a third party following
41	26		the procedures authorized under Section 263.003, 263.007, or
42	27		263.008, Local Government Code; or
43	28		[(2) the property is disposed of in accordance with
44	29		Subchapter J].
45	30		SECTION 2. Subchapter E, Chapter 775, Health and Safety
46	31		Code, is amended by adding Section 775.0735 to read as follows:
47	32		Sec. 775.0735. DISPOSITION OF PROPERTY. (a) The district
48	33		may dispose of property owned by the district only by:
49	34		(1) selling the property to a third party following
50	35		the procedures authorized under Section 263.001, 263.007, or
51	36		263.008, Local Government Code;
52	37		(2) selling or disposing of the property following the
53	38		procedures authorized under Subchapter D, Chapter 263, Local
54	39		Government Code;
55	40		(3) selling or disposing of the property in accordance
56	41		with Subchapter J; or
57	42		(4) selling the property using an Internet auction
58	43		site.
59	44		(b) The district may contract with a private vendor to
60	45		assist with the sale of the property.
61	46		(c) The district shall sell the property using the method of
62	47		sale that the board determines is the most advantageous to the
63	48		district under the circumstances. The board shall adopt rules
64	49		establishing guidelines for making that determination.
65	50		(d) In using an Internet auction site to sell property under
66	51		this section, the district shall post the property on the site for
67	52		at least 10 days.
68	53		(e) The district may reject any or all bids or proposals for
69	54		the purchase of the property.
70	55		SECTION 3. This Act takes effect September 1, 2015.
