205 relating to expenditures made by emergency services districts and
216 the sale of district property.
227 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
238 SECTION 1. Sections 775.073(a) and (d), Health and Safety
249 Code, are amended to read as follows:
2510 (a) Except as otherwise provided by this section, district
2611 funds may be disbursed only by check, draft, order, or other
2712 instrument that:
2813 (1) is signed by at least a majority of the board's
2914 commissioners; or
3015 (2) is signed by the treasurer, or by the assistant
3116 treasurer if the treasurer is absent or unavailable, and
3217 countersigned by the president, or by the vice president if the
3318 president is absent or unavailable.
3419 (d) Any property, including an interest in property,
3520 purchased or leased using district funds, wholly or partly, must
3621 remain the property of the district, regardless of whether the
3722 property is used by a third party under a contract for services or
3823 otherwise, until the property is disposed of in accordance with
3924 Section 775.0735[:
4025 [(1) the property is sold to a third party following
4126 the procedures authorized under Section 263.003, 263.007, or
4227 263.008, Local Government Code; or
4328 [(2) the property is disposed of in accordance with
4429 Subchapter J].
4530 SECTION 2. Subchapter E, Chapter 775, Health and Safety
4631 Code, is amended by adding Section 775.0735 to read as follows:
4732 Sec. 775.0735. DISPOSITION OF PROPERTY. (a) The district
4833 may dispose of property owned by the district only by:
4934 (1) selling the property to a third party following
5035 the procedures authorized under Section 263.001, 263.007, or
5136 263.008, Local Government Code;
5237 (2) selling or disposing of the property following the
5338 procedures authorized under Subchapter D, Chapter 263, Local
5439 Government Code;
5540 (3) selling or disposing of the property in accordance
5641 with Subchapter J; or
5742 (4) selling the property using an Internet auction
5843 site.
5944 (b) The district may contract with a private vendor to
6045 assist with the sale of the property.
6146 (c) The district shall sell the property using the method of
6247 sale that the board determines is the most advantageous to the
6348 district under the circumstances. The board shall adopt rules
6449 establishing guidelines for making that determination.
6550 (d) In using an Internet auction site to sell property under
6651 this section, the district shall post the property on the site for
6752 at least 10 days.
6853 (e) The district may reject any or all bids or proposals for
6954 the purchase of the property.
7055 SECTION 3. This Act takes effect September 1, 2015.
